Fired from Swift for mis-communication

Swift has so many trucks they probably don't know where there all at anyway... I wouldn't worry about it. There are other rotten companies to work for, just find another one.

In response:

Yes, I did follow up with my DM, but not HR. I wanted to CMA due to the fact that in case this happened, it would be documented.

However, without insult to my DM, he was aware of it, but forgot about it.
I have to remind the board that Swift DM's cover 40-50+ drivers. I like my DM but I also am frustrated @ upper management for giving him responsibility 40-50 drivers. Everytime I call him he is frantic and puts me on hold and sometimes calls drop.

I honestly think Swift could be a much better company, but that is wishful thinking. And there are good people there, but the company itself is overshaddowed by massive in-efficiency and beauracracy.

Big companies play games and they may have said it wasn't brought to an authorized location approved by his driver manager.

40 to 5p drivers isn't that much. I was able to run 50 without going to crazy. On top of dispatch we did our own logs, disciplined (coached) are drivers, did the drug pool, etc, etc, etc. Just sayin maybe you DM sucked.

Did you get anything in writing confirming the time off? I know the answer is no. Move on, get 10c per mile more with a better company, good luck, drive safe.

Did you get a response to the LOA? I hope your father is alright, but attending medical test for moral support is not a justifiable reason. But having to help your parent get around and caring for them while they are sick is.

The FMLA mandates unpaid, job-protected leave for up to 12 weeks a year:

to care for a new child, whether for the birth of a son or daughter, or for the adoption or placement of a child in foster care;

to care for a seriously-ill family member (spouse, child or parent);

to recover from a worker's own serious illness;

to care for an injured servicemember in the family; or

to address qualifying exigencies arising out of a family member's deployment.

The FMLA further requires employers to provide for eligible workers:

Restoration to the same position upon return to work. If the same position is unavailable, the employer must provide the worker with a position that is substantially equal in pay, benefits, and responsibility.

Protection of employee benefits while on leave. An employee is entitled to reinstatement of all benefits to which the employee was entitled before going on leave.

Protection of the employee to not have their rights under the Act interfered with or denied by an employer.

Protection of the employee from retaliation by an employer for exercising rights under the Act.

Non-eligible workers and types of leave

The federal FMLA does not apply to:

workers in businesses with fewer than 50 employees (this threshold does not apply to public agency employers and local educational agencies);

part-time workers who have worked less than 1,250 hours within the 12 months preceding the leave and a paid vacation;

workers who need time off to care for seriously ill elderly relatives or pets;

workers who need time off to recover from short-term or common illness like a cold, or to care for a family member with a short-term illness; and

workers who need time off for routine medical care, such as check-ups.

If you had done your homework BEFORE you took the job, you would have known that Swift is about the biggest piece of #### company in trucking. The 8-10% scam is still hanging on at a few places, but reputable companies are now paying practical miles.

One thing in Swift's defense, asking for a leave of absence when you have only been working there four months would leave a bad taste in any employer's mouth. Especially since you were probably in training almost half of that time. The request is absurd actually. You might want to do a little research on employee etiquette before you go looking for other work.

i agree with you if he took a leave of absence to go on a cruise of the carribbean......chances are it was some sort of family hardship or something, so i wouldnt be so quick to judge

These big companies,

it's all in how YOU handle a situation !!!!

As you can see, there was a lack of understanding,

and while you DID attempt to CYA,

the proper follow up was never implemented..........
