Carrier packet not completed and turned in question....

Have a question, say a broker hires an O/O to take their load but they never receive the carrier packet from the O/O and the O/O rolls the load or highjacks the load....who is responsible for the load??? I am under the impression that the broker would be responsible since they have no paperwork from the carrier.....
