I was rear ended by a 4 wheeler

Hmmm......that sounds REALLY odd. Towing a vehicle at 60mph.....coming up to r rr crossing and didn't see a 70k+ vehicle???? Hmmmm......

This is very interesting. I really hope everything works out in your favor. If it was a 4 wheeler vs 4 wheeler and one hit the other from behind we all know who would be at fault. Suddenly a truck is in the picture and people need to argue it.

 

Yes, it would have been required by the cdl driver whenever it is a dot reportable accident.

 

I just got rear ended by 2nd shift dispatch!!!!

 

He was hit by a car traveling 60mph and he was stopped. It bent his icc bumper, I am fairly confident that something was towed from the scene of the accident. If any vehicle is towed from the accident scene, it is considered a DOT reportable accident.

 

Just a scary thought; our trailers are required to have 'wide turns' signs on the doors, and not having such signs opens us to lawsuits. Drivers, as mentioned before, know placarded vehicles need to stop at level crossings, but 4 wheelers don't. How long before an enterprising lawyer notes the absence of a big 'this vehicle must stop at railroad crossings' signs and starts drooling?

 

that was my point (that Dave posted earlier) I know now that trucks with placards have to stop as I took the time to learn this but a few years ago I didn't and would have wondered why a truck was stopping at the tracks. I think a magnetic sign that can go on the back of the trailer to let people know 'this vehicle stops at RR crossings' would be a good idea!!

 

If you don't have an attorney by now,

your driving record will be the least of your worries.

I wish you good luck with this situation,

but most likely it will end up in a court room....
