Any real answer about gun carry?

    I have done a lot of searching and didn't see any real answers about this, only guesses. This is the only deal breaker for me. I have a TN concealed gun carry permit. I have never felt safer in my life and do not go anywhere without my gun (where legal of course). I leave it in my car when not allowed. I have done research on the best truck companies and so far Schneider and Central Refrigerated seem to be good companies.

    In states where concealed or loaded guns are not allowed I plan to lock it up and leave in the truck hidden. In states where the permit is valid (which are a lot):

    I will carry on me. If the company says no firearms I will not work for them. Are there companies that allow it? I am a night person and when I walk to the store and see a group of young guys acting tough in a crowd and staring at me I am not even worried. Carrying has made me a nicer person as before I would have to act like a tough guy too so they wouldn't mess with me but now I just ignore them. I am a tall guy and I attract a lot of attention and during high school thugs who I never even seen before would try to fight me so I learned to stay protected now.

    There is no federal regulation on carrying a concealed weapon in a cmv..As far as state regs go, as far as i know as long as the state your in accepts the permit from the state it was issued then your good to go.. Company policies (for you) will be the big issue..

    I carry everywhere I go, have ever since I got my permit when I turned 21.. All the states I run in accept my permit from Florida, and even if i go somewhere that doesn't my gun is still with me somewhere, its easier to ask for forgiveness than permission...

    I don't agree with it, but isn't it illegal to carry in a CMV? I can't, even with my CCW because of where I am usually. :biggrin_25525:
    Please, no stoning or crucifixion if I'm wrong.

    Federal law does not prohibit. State law varies as to reciprocity.

    No major carrier will allow it. What they do not know can get you fired when they find out.

    Find a small carrier and buy a lock safe for NYC.

    You have to comply with the laws in the jurisdiction you are at. So as you drive you are entering/leaving jurisdictions. Even with a CCW/HCP shipper/receivers and truckstops can post "no firearms" and you immediately become a lawbreaker just by entering their property with you weapon. To be legal you have to be in compliance with every state, county, city, location for your gun and in some places for your ammo. With careful storage you may be able to be legal as you drive through some of the communist areas, or you may not.

    Up until about a year ago I would have quickly said there is no federal rule/regulation keeping CMV drivers from carrying, but I have seen the regulation which seems to basically classify guns/ammo as prohibited in the CMV. My reading of that reg seems close to being a real prohibition so I no longer say "there is no federal rule against it"

    The rule/reg isn't in the same FMCSA as most others. I tried re-reading the gun thread in the Trucking Industry Regulation section and gave up..That is where the regulation was linked and quoted.

    To save you time, you can read that thread and skip over the first 25 pages and the last 10 pages, so that just leaves about 100 other pages in the thread. The regulation is quoted. The reason I'm not 100% clear it's a prohibition is because there is no "CDL/CMV drivers may not carry...". The regulation seems like it may be concerning cargo, IIRC.

    Surely someone else remembers that information or posted that info.

    I'm generally inclined toward carrying and might even decide to carry with a CCW/HCP even if the mystery reg I'm referencing exists. Now, standby for everyone with a gun story or opinion to fill up this thread with what ought to be, what some guy told him, or some superstition/wives tale about creative legal interpretation to arrive at their favorite conclusion. And I think we all win a prize after the first 100 respondents use the phrase "I'd rather be judged by 12 than carried by 6" which is pretty optimistic looking at some drivers.

    There are several other threads covering this subject. Finding a company that will let you have a firearm in the truck will be difficult. As far as a federal regulation, there is none. Tennessee has one of the most reciprocated permits, so that's a good one to have.

    Central will not allow you to carry a weapon of any kind in the cab. They even won't allow you to carry a tire checker in the cab as it could be used for a weapon. That is there official policy at least.

    There is no Federal law prohibiting handgun carry. As has been stated, only prohibition is the carrier, the customer, and local laws. If anyone wants a legal substantiation of this, go onto Askthelaw-dot-org. One of the former law officers there can confirm there is no federal prohibition to carry in a commercial vehicle.
