PLEASE HELP! I am in a serious jam. I was trucking for a company & I failed a random drug test. I went to a SAP counselor & was able to return to duty while in rehab & completed the treatment program except for the drug testing, ( I left the company I was working for before I completed the testing schedule & at the time did not know I was to complete the testing on my own). So after three years of being off the truck I found it difficult to find a trucking job, & when I did & got hired, I was ecstatic. After a month & a half, I went to do a monthly drug test as was required by the SAP, I was unable to provide a urine sample after three hours & was told to leave the facility. This resulted in having a "refusal to test" on my record now. I went to the MRO on my own the next week & he would not determine that I had a physiological problem which would prevent me from urinating, but did drug test me & I came back negative, (which I knew was going to be the result as I have been clean since going through rehab 4.5 years ago. A week after that I was fired from my job. At first I was told it was due to the insurance company saying I was too much of a liability. My second phone call to the company, I wa told the company's consortium told them to "get rid of me". Now my SAP counselor has told me that I have to start the whole process over again. This is incorrect according to the D.O.T. officer I spoke with. I need help with this, so if anyone can advise me please don't be silent. Thank you I hope to hear from anyone soon.
I NEED HELP.....PLEASE!!! was fired & don't know what to do

Dear ladywrongway03,
Well, I am considering the idea of getting my own truck & trailer & running under my own authority. I just don't know where to begin for my situation. The legalities of it, I mean. However, I certainly appreciate your feed backLast edited: Aug 7, 2011

Dear mnmover,
I don't understand what you mean, could you elaborate a little more? -
Was the test confirmed by the MRO before you were stood down by the carrier? Also, have you ever been diagnosed with "shy bladder syndrome"?

I don't believe you have to start the SAP process over again, since the DOT reinstated your Class A privileges again. The DOT released you upon completing their requirements (no driving a truck for 30 days and checking with a SAP and drug counseling) - that's all they asked for. Whatever your SAP suggests for your immediate future as far as random drug tests are concerned, is what you or the company you work for have to do. Not fulfilling these SAP requiremets however, is an issue between you, the company you drive for, and the SAP. It has nothing to do with the DOT. Their requirements are fulfilled. What you can do if you're not working is subject yourself to random drug tests and tell the facility to send you the results for your own safekeeping. Or the drug testing facility might send the results off to the DOT for you. Remember, the DOT reinstated your CDL privileges because you fulfilled their requirements!
Hope that helped a little..... -
I used to work for an O/O. Also I made considerably less money, I loved working for the O/O. I didn't have to worry about overworked dispatchers, stressed out managers, and the like. I'd settle for another shot with an O/O, even if the pay is less, than working for a large carrier.
