Georgia trucker arrested in NY for carrying gun without permit

    A truck driver from Georgia was arrested in upstate New York recently after admitting he was carrying a 9 mm gun in his truck that he purchased for protection.

    Lonnie Davis, 24, of Augusta, GA, was initially stopped by Niagara County sheriff’s deputies after he crossed the center line around 4:30 p.m. on Aug. 3 on Niagara Falls Boulevard in Wheatfield, NY, according to the The Buffalo News.

    Since when do you need a concealed carry permit to have a pistol on the shelf of the sleeper? Was it concealed? No. Was he carrying it? No. Do these states care if you get shot in the face? No. Stop going there. Let the morons starve.

    Ummm...."was initially stopped by Niagara County sheriff's deputies after he crossed the center line around 4:30 p.m".

    They likely thought he was drunk or on drugs, since the idiot couldn't hold it in the lines in broad daylight.... and that's probable cause for a search. If he hadn't made that violation, he would have never gotten stopped.

    If you get caught in NY w/o a NY issued pistol permit you are screwed there is a pretty good chance he will do some slam time....Last I knew it was like 2 years mandatory or something like that..

    Automobile carry:
    A loaded handgun may be carried in a vehicle by a properly licensed individual. (Loaded means a firearm with ammunition loaded in magazine or chamber or any firearm which is possessed by one who at the same time possesses a quantity of ammunition which may be used to discharge such a firearm.)     NYS is #3 in the nation for the biggest PITA to get a hand gun permit. Another thing they can get you for is the size of the magazine you have for your pistol too. NTS is like California and is restricted to a 10 round magazine.

    With all of that said, there is a federal statute that does allow you to have a hand gun in your truck as long it is property stored. Federal trumps state on this one, but you have to follow the law.

    If you were to do this I would say you need to print the law out and have a copy of it with you.

    There used to be a big billboard sign as you entered NY state that said:

    "Unauthorized weapon in vehicle is 10 year Mandatory in this state"!!
    And a picture of a guy behind bars.

    That was clear enough for me to understand...wonder what part of that he didnt get?

    didn't the fed gov't just overturn some state and local laws aginst gun ban and the posession of certain guns in NYS and D.C area? maybe like two three years
