The law DOES however state that you can not discriminate on the basis of disability or PERCEIVED disability. If a company believes that someone can not do a job for physical impairment reasons, but a physician has certified them capable and healthy enough for the job...they are opening the door for a major law suit. Requiring a sleep study and/or CPAP makes good sense. But if they still refuse to hire someone after the issue is corrected then they are blatantly discriminating illegally.

JHC! Can you not read? There are well over 100 pages of posts here, many of those posts are by a number of Prime employees who are in CPAP treatment that actively refute the ridiculous assertion that any illegal discrimination goes on.

No one is denied employment at Prime due to a medical diagnosis of sleep apnea. In fact the company only wants to ensure that their employees are as healthy as they can be. Driver wellness is actively promoted by the help they receive both financially, and in supporting continuing treatment with CPAP equipment and medical record keeping required by DOT.

Is that your experience or just something you heard from a guy who's cousin knew a guy who's uncle used to work there back in the 80's? How about some facts to back that up otherwise you're just running off at the keyboard.:biggrin_25510:

Ahhh....you must be a new Prime driver...... or have aspirations of such.

My brother, a driver of 30 years worked for them.
I sir, am not stupid enough to get myself into a lease purchase program.

EDIT: After giving it some thought, I decided to expand on my statement above.

My brother has always been a company driver, as I was, and worked for some good companies as well as some bad ones. He is one of those drivers that even when working for a good company thinks the grass is greener on the other side of the fence. He is gullible. He is the guy who falls for the Nigerian scams. When another driver tells him that a company is the greatest thing since sliced peaches, then it must be true, because why would a driver lie to another driver.

So, an ATS driver tells him that he can be an OO if he signs on with ATS and enters into a Lease Purchase Agreement. Curt jumped all over that. I tried to tell him that he would not really be an OO but a renter with the financial responsibility of an OO, but he couldn't wrap his head around that concept. So, he goes to work for ATS, agrees to pay $45K for a used up old Freightliner with 600K miles on it. The first week out he blows the transmission. ATS wont budge, he is contractually obligated to reimburse ATS for the cost of the transmission. He struggles for 2 months at ATS.

He then abandons his contract with ATS, and moves on to another Lease Purchase Agreement with another company (I can't remember who) and does poorly. He is unhappy, and moves on to John Christener (sp).

He does fairly well at JC until one of his rear axles take a dump on him and he has to pay for the repairs. He has some money in escrow and JC will front him the rest. He repairs the truck and he thinks he is making money until he talks to his book keeper. With the axle repair it cost him $27K to work for JC and his gross income was $32K for the year.

Then he talked to a Prime driver and off to Springfield he went. 1 year later he decided he'd had enough, and left Prime after he received a $6 pay-check. Said he was tired of living in his truck and eating out of his cooler. His family was living on Food Stamps. He had to sue Prime to get his escrow money back.

So new drivers, I say this, "Say NO!!!! To a Lease Purchase Agreement".
