Parking at home - Thoughts/comments needed

    First some background:

    -I run my own business out of my home. It is my DOT registered office/place of business.
    -I live in a typical (yet not snotty) residential subdivision with CLASS B roads. (Limit 6000lbs on a CLASS B road according to statute). Just your "joe" average single family cookie-cutter area. My home is on a DEAD END and the road (while kind of continuing after my home, turns into dirt/stone). My home is angled pie shaped and does not face anyone.

    -When I got the rig, I approached each of my neighbors up/down the street asking if anyone would have an issue with me parking (usually weekends only) in my drive. No one could have cared less. I figured that was a good start. Funny thing, is that the PD would drive by my home and even turn around in the driveway (since the street ends) and never said a thing to me - even when I was outside. Hell once I got a waive from the cop....I figured I was good to go. I even snow plowed the neighbors last winter to try and be a 'good' neighbor..

    Well fast forward 18months....

    My rig was in the drive for about 2 weeks, since I had sent my ECM out for a new program. Plus, my new DOT entry audit was setup for a few days away and I wanted the DOT to be able to review the rig if needed.

    Well two weeks ago, a neighbor calls 911 to report a lost child that wandered into their home. Oddly, the neighbor knows this kid and could have just delivered it ACROSS THE DAM STREET - but opted to get the PD involved. Well as you can expect, we had quite the PD response, especially when a kid is involved. I think 1/2 the force was over in my street..

    Suddenly...
    Sargent 'Jalopy' apparently took note of my rig and started asking the neighbors questions. They all told the truth, which is fine by me. "He brings it home to wrench on it or wash it and then puts it back at the drop yard"....Well he instructed one of his cronies to speak to me while he sat in his cumfy SUV.

    Officer McGruff came to my door and told me I cannot park this truck in my drive due to weight limit exceeding 6000lbs. I was polite and tried to reason with him and he eluded to the fact that he did NOT want to deal with this but that his SARGENT demanded it. Ok...well now we know the source but why this guy has a bone for truckers, remains to be seen.

    I was told to remove the rig within 24hrs and that the officer would be back to verify. Of course I complied.

    I asked the Officer why I couldnt just bring it on a Sat to work on it as long as I took it back, since no one seemed to care but his Sargent. He told me that while he couldnt say "YES" to that, that he wasnt going to go out of his way to check up on me.

    Fast forward a few more days....

    Spoke to the city. Contacted my Alderman. Explained the situation. He advised me that they cannot give me a ticket based on the WEIGHT LIMIT 3 TONS at the entrance of our subdivision as it's an un-enforceable stupid sign. He was going to talk to the city atty and see what thoughts he had..I wasnt looking for an exemption but some work-around or exploit of a grey area...According to the DOT, the officer cannot issue me an overweight ticket unless he has attended and been certified on 2 CMV sections. I cant recall them but I would be he isn't.. - The City statute is written but albeit a bit vague:

    Restrictions on Use of Other Streets by Heavy Traffic. No person shall operate or move a vehicle, except a motor bus, which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding six thousand (6,000) pounds on any highway not part of the heavy traffic route designated in Subsection (c)(1) above except for the purpose of obtaining orders for, or moving or delivering supplies or commodities to or from a place of business or residence which has an entrance thereon; provided, in no event shall the weight of vehicle and load on any street not defined or designated as a heavy traffic route under Subsection (c)(1) above exceed the limitations of pertaining to Class "A" high- ways or deliveries on Class "B" highways established by the Wisconsin Statutes.

    So I am wondering if anyone else on here has dealt with this and what progress/failure they have had and how they did it.
    I just dont understand why I am hassled when no one cares (but the Sargent) and living on a dead end street I cant imagine what harm this is causing.
    Oddly enough, I noticed a neighbor about 4-6 blocks away has a Class B motor home. Online, the model shows 14,500 for it's weight. :biggrin_25512:
    In the meantime I have been asking/checking around for parking that will give me more options that just a basic drop yard with no shade or electricity or anything.

    Having dealt with similar situations over the years I have just "complied" temporarily until "Seargent Buttstain" loses intrest and then continued to do as I please.
    It seems like they will come and make you move it and as soon as they see that you have done as they say, they are satisfied that you "respect their authority" (joke) and then they go off to harass some other poor unsuspecting slob that's not doing anything wrong.
    Just wait a few weeks and go back to what you were doing before and the regular cops that patrol your area will continue to "not notice" your truck sitting there from time to time and "Seargent Buttstain" will probably never come back down your street because he's busy being "really important" elswhere.

    You can come park that nice KW in my drive way if ya want, lol. Goodluck finding a parking spot, its tough.

    I had a very similiar problem in Sun City, Ca. a few years back. It was a retirement community, un-incorporated, in Riverside County. Sun City was it's own little "burgh", with it's own little "board" and rules only pertaining to Sun City. Mostly they were concerned about keeping out under 55 residents. None of the streets were posted and all the homes were duplexes or single family.

    After about a month of parking in my driveway on weekends while on hometime (BT), I get a letter from the "board" stating I'm overweight and must park somewhere else. I dispute it of course and say show me the law, IN PRINT, where I'm in violation. Yes, there is a law in Riverside County forbidding parking CMV's in residential areas, ON THE STREET. However, on your property is OK. The "board" scratches their head over this and meanwhile, my company calls me and wants to know about this neighbor who has e/mailed them ######## about my truck parked in my driveway on weekends. The guy ######## is a retired truck driver ! I get his name and knock on his door which is 4 blocks from my house. He says my truck detracts from the neighborhood appearance. Really ! It's an '06 in the year '06 and washed every week end in my driveway and wheels shined etc. Neighbors have 30 year old junkers with cobwebs from the ground to the wheels, hey, no problem, right ?

    Anyway, this back and forth goes on for months, with the "board" contacting the County and getting the law amended to state nothing over 3/4 ton on your property. Just so happens I'm moving away anyway. My advice, fight them. Cops can't say it's illegal to park heavy vehicles in your d-way.

    See this is the 'gotcha' I am after....but I dont know if it will work.
    Then, presuming it does - Watch next year as the "HANADARKO" clause gets amended to our parking laws. :biggrin_25524:

    It has been suggested I speak to the Chief of Police about this.
    I'm not sure that's a good or bad idea. :biggrin_25512:

    I recommend NOT contacting the Chief of Police about this!

    If you drop it now and don't attract too much attention to your situation, it will soon be forgotten but if you keep making noise about it to the higher ups...You'll attract the wrong kind of attention to yourself and it'll become a "mission" for some punkass cop to "teach you a lesson" for trying to get around their precious rules.

    I guarantee you that the "Chief" will react to your situation in a way that will not make you happy!

    I second this thought! The sergeant will become your own personal hemorrhoid if he thinks you went over his head. Not worth the risk.

    My town passed a law that prevents commercial vehicles over 10,000 lbs being parked on residential property and streets.

    They stopped by once when my bobtail was home.

    I presented them pictures of other commercial vehicles over 10,000 lbs and asked why they were not removed as well.

    Electric company boom truck for on call worker.
    Plumber truck and supplies for on call worker.
    Several service trucks.

    Nothing was ever said to me again.

    My alderman got back to me today. So far he has found that this supposed ordinance is not enforceable. He asked me if I had seen or been approached by any PD and I told him I have had ZERO contact since that one day... Well apparently he is good long time friends with 2 people in the city, including the Chief of Police. He wants to run this past him (based on my personal situation) and see what the issue really is and if we can get a 'dont ask dont tell' kinda permission.

    I will know more Friday. I am hopeful but not overly optimistic.

    It's a nagging thing with me since i live on a dead end street. The road literally ends at my house. I can't see who I am bothering especially when the neighbors get curious and come over to chat with me :biggrin_25520:...

    I love the "Wow...look at the size of that..." :biggrin_25525:

    ....of course then I realize they are talking about the RIG and the smile sorta falls off my face :biggrin_2556:
