Looking for someone to take over our contract

    My husband and I bought a 2004 Western Star from an individual couple 15 months ago. We have an agreement in writing, but there was no financing through an institution involved. This couple was highly recommended by our mechanic, so little did we know they are demons straight from the bottom level of hell. Even though we make all our payments (99% on time) and have never missed one, if we mail the payment on Friday and they don't get it on Saturday, they're calling my husband's job to find out where he is and then calling him and telling him to bring the truck back by such-and-such time. We've paid $24,000 on this truck so far and have put many thousands of dollars of repairs in it. We still owe $34,000. Because it is now Sunday and they didn't get this week's payment yesterday, they are demanding we make 2 payments this week or he can bring the truck back. (They will get Friday's payment tomorrow - it was faithfully mailed on Friday as all of them are.)

    I don't know how much more we can deal with these peoples' threats or calling his company all because the post office didn't deliver their payment as fast they thought they should. This is causing him tremendous stress on the job, and is causing me to have panic attacks. We have never dealt with people like this before. We think they want the truck back since so much has been replaced on it so they can re-sell it to the next poor jerk. My husband stays out 8 or 9 weeks at a time and runs constantly out of absolute terror of these people.

    Do you know of anyone who might be willing to finance the remaining $34,000 we owe that would take over our payments? Our credit rating is fair, but that's because we pay the truck payment first plus have done a lot of repairs on it. I think one of us is going to end up having a heart attack if we don't get out from under these people and their continual bullying. Thank you for any help you can give us.

    Send the payment three days earlier than you normally do. Keep the receipts for repairs so they can't use them to market the truck to some one else. Anything else?

    How you let these people affect you is your choice. I can understand how a couple looking to build a dream can find them self in the situation you are in. BUT, it is what it is. The fact is that they are in a financial bind or they would not have cut the deal with you that they did. In entering this agreement you hooked your dream to their falling star in hopes that you can save them and build your dream too. The big picture is they don't want the truck back because they can't pay for it and the hooked their drean of paying off the truck to youe star. To help relieve the stress, when they CALL, feed their ego and reduse their stress. Stroke their ego, sure are glad you called, thank you for helping us stay on track, happy that we are working together for our joint success, these are hard times that we the people will work through together so we can all be winners. you can suttley include the message that, we can work together and both be winners or you can stick this truck up your a.. and we can both be loosers. Ask them point blank which of these works best for them. let them know you are doing the best you know how to do and remember if they had been doing all that well they would have given the truck to an upstart trucker, fact is they failed as an owener/operator or they would not needed to sell the truck under the terms they did. They failed for what ever reason, and are looking to you to bail them out, they think they are in charge and you are helping them think that, fact is who ever is sitting in that drivers seat is in charge. The person sitting in the drivers seat can use that machine {tool} to generate money. If no one is sitting in that drivers seat that machine will rust and deprecheat in value every day untill it is nothing but rusted pile junk for the scrap yard. They can only upset you if you let them. you should know in your heart that you are doing the best you know how to do and if they can not except that give them the truck and get a company jod and start saving your cash to build your dream. there is a reason that truckers are known as 20 year over night success's. if you want to be rich, be a doctor or invent a new apple computer. if you want to be a trucker, know your numbers and if the numbers don't work fire the people who are holding you back and hook your star to someone else, if those numbers don't work... well you get the plan. How to become a successful independint trucker is HIGHLY coveted information in this country. If you swee a truck rolling on the street with the name RDHUCKS on the door, ask me and I'll be happy to share what I know. There is a shortage of truckers in this country but there is also an over abundance of steering wheel holders who think they are truckers. Information and how you let it affect you is the key.     First thing I would be doing is reading that contract you have with them. What does it state about late payments is there any grace period in the contract? What does it say if you fail to make a payment are they able to repossess the truck? You need to know that contract better then they do that should be your first step in this. Follow that contract to the letter if there is nothing in it about if you miss a payment date that you need to pay 2 payments then they can't demand that of you.

    You need to read that contract, when you finish, read it again. I only hope that you can find something in it that will keep these people from terrorizing you any further. Just remember that contract is law when it comes to the agreement between you and them. You can't violate it but neither can they. If it says they need to receive their payment before a certain date make sure it happens.

    I'm not certain but I believe in many states it is illegal for a bill collector to contact your employer while attempting to collect a debt. That may be something you need to research also. If that is the case then you need to tell them if they continue to contact the employer you will seek legal action. You may also research repossession laws in your state, they may have a more difficult time then they think reacquiring the truck. If it is a process that would be drawn out you may point that out to them. If their finances are in jeopardy this could make things worse and it may make them realize that and ease up and be more friendly when dealing with you.

    It almost sounds to me like they are relying on your payments for their finances and the insisting on dual payments may be due to them having financial hardship.

    What smarttowers said is good input. I wish you the best. I have seen little dogs chase big dogs away but remember a big dog can turn around and bite the little dogs head off if the little dog dets too close. If it is too much stress tell them it is too much stress and they have to back of or take them the truck. I don't meen to sound too hard about this but fact is both of you made the choices that brought you to this point. Sometimes it is hard to except the facts but if you have taken on more vthan you can handle why fight the eneveadable. But, don't take no s... from these people. We learn from our mistakes or we repete our mistakes.

    Have you considered that they might not be making THEIR payments on time? You guys could have that wagon repo'd right out from under you by the bank- or seller's finance company. If that happens, you've lost it all.

    That's what written contracts are for.

    If her story is true and accurate, she just needs to send in the payment a few days earlier to beat the mail lag. I suspect it's more than a couple days late and more than just a few times it's happened.
