Sounds like another person blaming someone else for everything that happens to them is someone else's fault. When did this country get this bad? #### is a man not even a man anymore. Come on shoeless man up admit you smoked a little and listened to some of your other buddies tell you how to beat the test and now you realize that they were just lying cuz you failed. You wanna know how to get into this industry? Admit your mistakes, clean up your life get some help and give it time as far as a positive drug test it goes on your DAK report (its called something else now). It will always be on your report i believe they're permanent. Maybe try another career. Good Luck

If you don't have a cdl and you weren't an employee, it's hard to see where that failed test would go. They couldn't put it on a DAC because you weren't employed, and if you weren't an employee there is no reason to tell the next company about it. The system is built around employee's failing the test.
Move on to another school and try again.
As to the ex-girlfriend, first be thankful she didn't end up being the ex-wife, second see if she will admit to spiking the cookies to witnesses, (people who will testify in court). She's done you possible lifelong harm by her antics. At the very least she should have that MM card taken away from her. -
Okay, I won't be so quick to doubt you, I've been married 32 years and we both wonder how I've lived this long. For years now, I expect to wake up with a meat clever in the forehead or with something surgically removed.
Never, never- and we know now- NEVER make a girlfriend (or a wife) angry enough to get revenge. They will. And it will hurt.
I think, first thing you should do is decide how bad you want a driving job. If you hired a lawyer and made this whole problem disappear, what would you be willing to pay? Would you be willing to file charges on your girlfriend? Could you sue her? Would she admit it in writing?
You're at a strong disadvantage here. There are TOO MANY people in this career field and trucking companies are working overtime to fire and disqualify as many applicants and older drivers as possible to keep driver pay low. So only small companies that are having a difficult time finding drivers actually need them.
I don't know if you tested and got a CDL before this happened, or if you were disqualified before getting one. You CAN get a CDL on your own without a school and work for a small outfit. Before driving schools were so popular, drivers started as yard hostlers and mechanics, or warehousemen. To get a yard jockey's job you could look for a place no one wants to work in- like a poultry co-op or packing plant, then work your way up until you get into trucks. That could take awhile.
If I knew a lawyer you could trust, I would send you there first- but always trust lawyers less than you trusted your girlfriend. In most states you can request to have incorrect or false information removed from your driving record, So it would make sense to drop by the local DMV and see if you can get a copy of your drivers' license record. Then request a copy of your DAC report to see if you actually have a DAC report, and what it says. If you just showed up for driving school and immediately failed a drug screen, they might have never released the info to anyone.
Well, no matter what anyone says- don't go on rumors, get the facts and make a decision. See if it actually is on your driving record, see if anyone started a DAC report. If not, apply at another driving school and stay away from baked goods.

I have a hard time wrapping around that story for a couple of reasons.
1. Ex-girlfriend is a "medical marijuana" user. Which means that you have been around a pretty cheap and steady supply of pot for quite some time.
2. You scarfed down whatever baked goods she *burp* had , enough to piss hot, but never felt any effects? I would have to guess that if you were dirty enough to blow a UA, you had a buzz going. So ... if you were the victim that you said you were, it would have been prudent to spin the car around, tell the trucking school something came up, and headed home.
3. You never questioned her if the baked goods were loaded with anything. Bzzzzt!! And, if you broke up with her to begin with, why did you stop by, and then accept "goodies" for the ride to school? That's just plain gullible. I would be less embarrassed to admit I just didn't give myself enough time to clean out.
I call B.S. I would have to guess that you and girlfriend used to do a little *cough" medicating together, and you didn't give yourself enough time to clean out before heading off to school.
I'm not all too sure of the repercussions of failing a UA before you actually obtain a CDL - and I'm not sure whether or not it winds up on a DAC report or not. I would go to hireright and request your own free copy. At the very least, you are disqualified for that company school. If your situation does not warrant you taking the s.a.p. program to be qualified to drive, then take some time, make sure your cleaned up, and look into other options.
And don't stop by and visit Betty Crock-pot again.
You could take it to the Supreme Court, charge your ex-girlfriend with felonies until the cows come home, and it's not going to matter a bit. You're in the same boat as me, who let some poor judgement during a hard time in my life trash a 30 year career, or the poor sap who didn't get to the clinic on time. Momma always said, "Positive is as positive does, Forrest..."
If, and only if, you are being 100% honest with your story, I apologize. But I've read every thread on the internet with regard to the subject, talked with substance abuse professionals and human resources people both, and it is the most used and oldest story in the book that you unknowingly ate some THC.

Exactly. I never seen a couple where one smokes and the other doesn't. They give them cards out to anyone who wants one.
I'm sorry bullhaulerswife, but it's too far fetched to believe and most don't. Why not just say I failed a test, what can I do?
He's been around the forum long enough to know many members don't take to pot heads and the stories they bring. So he knew it had to be a good one.
Let's just say she really done that. He could sue the crap out of her.
I've had some pretty far fetched things thrown at me before that nobody would believe. How you present yourself makes a big difference.
What's he expect for an answer? Someone to post, Oh, yeah I had a girlfriend that snuck me pot brownies. What you do is....

The only thing I can do is agree with Dave..... If I was leaving my wife of 30 years I certainly would not eat or drink anything she fixed me,
and I'd sleep with one eye open in a pair or steel underpants!

I was at the Academy for FFE transportation. From what I understand, a failed test from their school will be on the DAC report.
