I dont see why you think you dont have constitutional rights? If a LEO ever told me that I cant say this that or the other, tell me that I have to talk even after I decide to exercise my 5th amendment right and then says that they are going to search my vehicle without probable cause or a warrant(4th amendment right) I will laugh at them then request the presents of a US Marshal to read the idiot my rights and tell him to screw off.
Also Batman I have had friends get arrested, were not read there Miranda Rights and they spent time in jail until they went to court and the judge dropped all charges and the arresting officer was in some serious trouble. Happens all the time and like said above if your put OOS for not cooperating with DOT, what is it exactly they are going to write you OOS for???? Once again request the presence of a US Marshal who will once again tell the DOT officer he is an idiot and he needs to learn how to do his job.
CRZY, I thought our jobs are fairly stressful also which they do not take into consideration a lot of times so why should I be respectful towards somebody who is not being respectful towards myself? If the LEO is having an attitude right off the bat what makes you think he is going to be nice and for what reason should I treat him or her with respect.
I fought and earned those constitutional rights for both myself and all of you here so why should I back down from exercising them when I see fit?

Why? If a LEO observes you doing something illegal, nothing in the constitution is going to stop that LEO from issuing a citation or making a arrest. Exercizing your right to remain silent won't prevent this. It only makes you appear as a total arse to the LEO.
-
A LEO's job is more stressful than ours. They have to put up with the worst civilization has to offer every time they put on a uniform. A LEO's job is perhaps one of the most underappreciated jobs in the country.
There are proper times to use your costitutional rights and improper times. Using your 1st amendment rights to tell me I'm a idiot isn't going to stop me from giving you a fat lip. The LEO is going to write you a ticket or make a arrest regardless of the constitution, provided they observe you doing something illegal -- or you were observed doing something illegal. The constitution applies in court. Not on the street. -
We already know this to be true. If you had watched the video you would know why never speaking to the police would greatly benefit you especially in this situation.
-
That's what it means... Anything you say can and will be used against you... nothing you say will be used for your defense... Even if it shows you have done nothing to warrant the citation of the accused crime.
Sadly, crimminals are well aware of this, and many times they walk because of it... It's the average Joe's that just are trying to make a living and cooperate that find out later how they really screwed themselves... thinking they were only doing the right thing. -
If you already know that to be true, then why debate with me? I'm talking about before a arrest, not after.
-
Because this means never talk to police no matter what regardless if you are under arrest or not. Again if you had watched this you would know why! Even the officer in this video says the same thing!
-
Ok so your constitutional rights do not apply outside of court??? Sure about that??? Think about what your saying. Look up the 4th amendment. Do they wait to do the search and seizure of your vehicle or house until your in the court room? You dont have the freedom of speech when in public to LEO's? You cant plead the 5th to a LEO??? Really??? Come on, think about what your saying.
-
And I disagree. Not talking to the police isn't going to stop them from issuing a ticket or making a arrest. You CAN talk to them, just be cautious of what you say. That's all I'm saying.
Pull into a scale house and exercise your 5th amendment rights when the DOT officer asks for your logbook. Let's see what happens. -
We have all of those rights...An LEO may search us, but it still has to be lawful...Nothing removes your right to free speech...Our rights under the constitution are never limited...
