    Really so if I get pulled over for speeding and I admit to nothing nor say anything and just plead the 5th amendment they are going to arrest me or issue me a ticket for exercising my 5th amendment right??? I would love to see that stand up in a court room.

    The problem is that to many people do not know the constitutional rights that they have or how to use them. Just because somebody has a badge does not mean you have to answer what they are asking you.

    And please explain to me what you said before about the constitutional rights we have not being valid outside of a court room???

    That was a exageration. Some people think the 1st amendment implies they can say whatever, whenever they want, when it doesn't.

    Why do you ensist on overexagerating what I say? That's very annoying. If you get pulled over for speeding, no constitutional amendment is going to stop the LEO from issuing the ticket. A ticket means you were charged with a crime, not convicted of it. There is a difference.

    And yes, refusing to cooperate can be a chargable crime, in some cases. The crime being interferring with a investigation.

    Really threatening to kill a LEO? Is that not going a little over board?

    Where is this exaggeration you speak off???

    I also do know that a ticket does not admit to guilt.

    I said that to prove my point that you don't have 1st amendment rights. Not in the sense most people think. Anything you say or do can and will be used against you in the court of law, which is the 2nd part of the Miranda Rights.

    Actually they will, or should I say try, to charge you with obstruction for remaining silent. Which almost ALWAYS gets dropped... It is a scare tatic they use to try to coerce the detained into cooperation. It's effective as it is almost always charged as a felony.

    I dont see how I am exaggerating about anything. Yes they can give me the ticket that is fine but for them to issue me a ticket or arrest me for not answering any questions a LEO asks me on a basic traffic stop I would say that is not going to hold in court because all I would be doing is using one of my rights like the right to have a lawyer present, the right to remain silent, the right to plead the 5th you know those ones. Its not illegal by any means.

    It was also stated that DOT can put you OOS for not cooperating with them? Once again what would the OOS ticket read for the reason of being put OOS?

    Its not called exaggerating, its called being thorough and having attention to detail. What can I say that is the Marine in me.
