I have no disagreements with you on that. Many people do think they can threaten somebody and think that is part of there freedom of speech which it is not.

Your 5th amendment rights isn't going to stop the DOT from placing you OOS. If they have probable cause, you're going to get parked and searched.

You have to provide the log book if ask you just don't have to discuss the contents of the document. Nothing else needs to be said it's in your own hand writing or you accepted the Qualcom message to be accurate.

    THBatMan8 Thanks this.

Ok I am saying this because before it was said that if you do not cooperate with them as in not answer any questions asked, they will put you OOS.

I know probable cause is a reason for search I believe I stated that earlier when I talked about the 4th amendment right which is useless like you said when a LEO has probable cause. O and a search warrant some times is not good enough to over rule the 4th amendment.

I know that if they ask to see your log book you do have to give it to them. I'm pretty sure that is legal document regulated by the FMCSA so if they do ask you for it you have to give it to them, no exceptions. I do know that because we are commercial drivers we have certain things that we have to do and cant refuse because that would be illegal for us but at the same time that LEO has certain rules and regs to go by which they seem to not follow a large portion of the time.

I'm not agreeing or disagreeing with you, some things you don't have a choice in IE. operation of a motor vehicle is a privilege not a right hence statue covering the use of seat belts or the need to poses a drivers license or in your example providing your log book if asked. Things you do have a choice in speaking to a LEO concerning something that could possible implicate you in a criminal process.

Like this one, I'm not sure about anywhere else but where I am in IL it is against the rules and regs of police to be parked and shooting radar or laser with no marker lights on when it is dark out. It can be said it is entrapment or endangering other motorists.

That was coming from a couple friends of mine who are police officers in the suburbs of Chicago. Just like one told me that if I was to ever get pulled over after having a drink even if I had 1 and know for a fact that I can pass a breathalizer DO NOT BLOW!!! right out of his mouth "NEVER EVER BLOW IF YOUR PULLED OVER FOR A SUSPECTED DUI"

I'm not sure of the rule in IL but here you should never submit to any road side tests and always request a blood draw. Each agency has phlebotomist on staff or will escort you to the nearest hospital for the blood draw.
