Which is why you should shut your pie hole. Don't say a got dang thing. Because ANYTHING you say can and WILL be used against you. If the cop has enough dirt on you to issue you a ticket or arrest you, NOTHING you say will talk that cop out of writing that ticket or cuffing & stuffing you. If they want to build their case, make them work for it....don't help them by inadvertently saying something which they can use to piece together a plausible story to convict you. If you wish to present a defense, the courtroom is the time and place to do it...not the side of the road.

Even in a CMV, you still retain ALL of the rights protected by the Constitution. Your career choice has no affect upon those inalienable rights.
If you are stopped by a LEO while driving, hand over the required documents....license, registration, any permits required by the state for the load you're hauling, insurance, medical card, current day & previous 7 from your log book, and BOL's if you are loaded. That is all you are REQUIRED to have. Nothing else exists (or at least I don't carry it in my truck...therefore in a roadside inspection, it does not exist). If asked for more, remain silent. If asked for verbal confirmation of information contained in the log book or any other paperwork, remain silent. Nothing you have to say is going to cause the cop to go easy on you....but something that slips out might get you another charge against you....so keep your mouth shut. They cannot charge you with anything for refusing to speak.
Your silence cannot be used to presume guilt of anything, nor can it be used as the basis of a search, as your refusal to speak is not "probable cause" of any wrongdoing.
If they ask that you exit the truck, do so. Comply with their demands. If they arrest you without cause, do not resist...but keep your mouth shut. Talk only to your attorney, and go to court. If the arrest was made under fraudulent terms, sue the pants off the cop and his department.

My question remains, if your not talking/being silent wouldn't that trigger the DoT guy to conduct a level 1 inspection? the " your being difficult so im going to be difficult" mentality

He could be a horse's butt, but there's nothing you could do anyway to stop a level 1 inspection. If he does one, stay silent. He'll ask you a bunch of questions about your logs to try and get you to talk, he might even make you think you must speak or get cited for something. It's a bluff. Simply explain to him that all your information is complete as required in your logs. He does not need any more details.
And, yes- at this point he is trying to make you talk- you can bet by now he WILL use any words that you utter against you. So if you decide to remain silent, stick with it, no matter what.

Barry's a great teacher. Of course none of us have dope (I hope) around us, but aside from the fact that these videos are centered around narcotics and drugs, it applies to everything in a traffic stop or a weigh station.

Just 3 weeks ago now pulled into the coop on the MN WI line going into MN and pulled onto the scale. Scale master came out and wanted to see my logs, I had 30 minutes left on my 14 and I had about 20-25 miles to go. Well I gave him the logs he was looking real quick looked up at me and asked where I was going, I told him and then he saw my Afghanistan Veteran hat on my dash. He closed my binder gave it to me and said have a good night.

My company's safety guy used to be a DOT inspector and showed us a video at a safety meeting that was a training video for DOT inspectors on how to question drivers on their logs and how to trip them up. It was very interesting to see the "other side" so to speak.
