I know people keep saying in a lot of responses that "O well if you dont speak the LEO will do this or the DOT will do that" just always remember even though you are refusing to speak or to consent to a search by a LEO always do it respectfully! If they then decide to violate your rights because of it then its their behind on the line not yours. If you are guilty of something not speaking will do nothing but help you in the long run.
For those of you that didnt watch the video posted by the OP do yourselves a favor and watch it and you will see exactly what we have been talking about. Arguing about all of this really doesnt make much sense if you havent. I mean who knows the facts better than a law professor and a 20 year veteran police investigator? I will take their advice over a truck stop lawyer anyday!tirednaz Thanks this. -

I mean really? The US Marshal's aint gonna come out to some scale house for your piss poor interpretation of your constitutional rights in regards to the FMCSA rules and regs.
Its never happen and it wont happen unless you just happen to be a federal fugitive then they might come to your aid...........and give ya a ride to a federal pen. -
The "Federal Marshal" myth is a hoax. An officer that I know from my hometown P.D. retired and is now a Federal Marshal, he works in the Federal Building in town. We caught up on old times one day and I asked him about Marshals and trucking. He told me he has nothing whatsoever to do with trucking, transportation, trucks, truckers, or weigh stations. He didn't even understand what a weigh station was for. He has never heard stories of Marshals arresting other LEO's for anything. In his own words he said his job is to escort prisoners, man the X-ray equipment in the Fed Bldg and once in awhile fly around the world as a volunteer in the Air Marshal program.
For kicks, he gave me his card- he wrote on the back "Don't call me, I'll call You"
He says "No way I'm driving out in the country to arrest some Truck inspector or Trooper, that's the FBI's job".
I hear the "U.S. Marshal" B.S. all the time from a lot of people around trucking. You guys watch too much Walker Texas Ranger on T.V.. My friend's closest guess is that in a real pinch- when all the other Federal LEO's are too busy they might make Marshals do another agency's duties. "But", he says, "I'm not doing it, no way". -
What? U.S. Marshall are responsible for interstate commerce...So yeah, they do have something to do with trucking... interstate trucking that is... Either your Deputy U.S. Marshall doesn't have a clue about his job(he is a Federal employee).... or he's shining you on.

Nope- U.S. Marshals transport prisoners and man the X-ray machines. Period.
Well, Ok- a few other duties, but NOTHING RELATED TO TRUCKING.

You can do as you please, one of the great reasons for being an american, but enjoy your ticket, Me?, I rather leave with out a ticket, but I dont have run in with LEO's on a regular bases

Watch the video and see what the cop says. Any time a cop talks to you is an interrogation. They just use polite words like "interview" and such because it is more politically correct. You are correct in that it doesn't stop an LEO from performing an arrest or getting a ticket, but keeping your mouth shut will sure make things easier on an attorney at the other end of this confrontation.
I would be willing to bet, that all the ruckus that OOIDA went thru with Minnesota and the fatigued driver junk could have been reduced or even avoided by those drivers just keeping their trap shut. After all, it was a questionnaire for the LEO to use on the driver. And even a search could have been ruled invalid, if the driver just would have stated (as is in the video), "I don't consent to searches". The LEO can still do what he wants, but when it goes to court, he then would have to verify the "plain view rule" or substantiate probable cause. If the driver so much as leaves the door unlocked when they step out, then it is all fair game.

What officers now evoke, is implied compliance. In other words, they imply that you MUST comply with their lawful order or questioning. It's a way they tiptoe around an indiviuals Constitutional Rights. It's a play on words and really comical if you think about it... but it's used every day
