Duis holding me back!!!

    Hey! Out there.hope all you drivers are having a great day.
    Just wanted to hit you all up for some serious info some of you might have. Heres the skinney on me. Been to school and then found out most all trucking co.s will not hire you as a driver if you have more than 1 dui. Yes thats bad.truth is i accumulated 3 the last being in 1995. Of course they dont tell you up front. Theyll say like it has to be 5,10, years ago. But not 2 or 3 in a life time.hell you life is over-theyll even tell you well never hire you!!.that ll make you day when you have dreamed of being you own man/boss. Its the same with a prison guard. I was all set to hire in as one just last week when i found out. Could not hire in the local state prison or the private prison near by. I been out of work since jan. 2009.before that i was a traveling respiratory therapist for 16 years.
    Question is- does an o/o have this problem or would one be able to bypass it as an o/o. Please pass on any info you might have.much thanks and i pray i will one day be out there on the road with you, god bless. Sid.

    You might get lucky as an O/O, but IF you can get insurance, it will cost you a fortune.

    Chances are slim but there might be an o/o with a couple of trucks out there somewhere willing to hire you. If you're thinking of creating your own job, buying a truck, etc...... ....unless you have piles of money in the bank already and a real heart felt ambition to truck don't waste your time/life digging yourself into a hole that will take forever to get out of. If you heard there was good money in trucking and that's why you want to do it.. ..you're making a huge mistake. Don't do it. Probably not what you want to hear but it's the truth. Too many come into this industry for all the wrong reasons, spend a bunch of money to get license etc, then they can't cut it...

    It would be a little easier as an O/O, but not much. reason being, you have to fill out an app when applying to lease on and truck company doesn't want "cowboys" representing them. But, buy a truck/trailer and get authority and be a "lone wolf" as we use to say and you're good to go. That's AFTER you pay out the wazoo for insurance.

    See this part of 383.51. In short, you must contact your state DMV and get some direction. You can get reinstated from a lifetime disqualification once. Do it again and you're done. The age of the convictions, and getting them long before holding a CDL may introduce some gray area on how your state assesses your record prior to approving issuance.

    With the last being 16 yrs ago, insurance rates will be affected mainly by the newly issued CDL. However, most big carriers will just say no to three DUI convictions without consideration. Smaller carriers will vary, depending on how much risk they're willing to take. In any event, the moment you are involved in an accident, it will be like those DUIs happened yesterday as far as the victim's lawyers are concerned.

    Even if you're disabled on the side of the road with your hazards on and triangles out and some drunk "victim" runs into you.

    383.51 does NOT pertain, in this case ...........

    Find another line of work.....Trucking ain't gonna happen here...
    You wasted either your money or the government's money on a CDL mill school....

    It doesn't say one way or the other. It just says "disqualified," and there is no further statement that I could find telling more or less about what or how far back that means. Georgia (and probably most other states) makes you sign a form stating that you are not disqualified under 383.51 when you apply for a CDL. How thoroughly that is checked out or not is a mystery.

    I'm simply pointing out the relevant regulation so the OP can go off and find out from his state. Or an attorney for that matter.

    Things that stand out to me are the ten year requirement before eligibility and the fact that FMCSA and probably this particular reg did not exist prior to 2000. I am not a law expert, so maybe someone who is or who has gotten a statement from LE or an attorney might add something.

    I am all about giving people a second chance, but u were already given one, and then a third. You do not belong behind the wheel of a car, let alone a tractor/trailer. Suck it up, you ruined your chances at this career and maybe you should have done a little more research before spending (most likely OUR) money on training. So thank you for doing nothing once again. Go hit the unemployment line for another 2 years as you have since 2009. I'm sure they know you by name.
