My brother has been driving a truck for just under a year. He recently clipped an oak tree limb - was watching the right side to clear a telephone pole when the he caught the tree limb with his left side of the trailer. Yesterday they told him he's been written up for a Class One accident, and put on probation for 12 months. Forced him to sign the form on the spot or face termination for insubordination. Seems to me that hitting a stationary object isn't a Class One - which he tells me is the same as hitting another vehicle or a fatality. He knows he made a mistake - and accepts responsibility - but this seems to be a HUGE over punishment. What can we do??

Slow down, watch both sides, and don't hit anything. In 12 months he will see that it really wasn't any punishment. Depending on the cost of repairs many starter companies would have terminated him for striking a fixed object.

Probably means preventable as opposed to non preventable accident.My son clipped a tree while driving though a detour on a foggy night,took off a mirror,that was listed as preventable.When he hit a deer he put down that it ran into him,this is a nonpreventable.His company (Swift) allows 3 preventables in a year;more than 3 and you're terminated.

I'm suprised they didn't list it as preventable, especially if it happened during the hours deer are most active. For many companies, it takes an accident to be caused by an act of God tobe deemed non preventable!

Sounds like a company evaluation system. I've never heard of a rating system like that. However, 12 months probation seems like a good deal when most companies would fire the driver. If I were him I'd take the probation and learn from it. Anything else would only show him as a trouble maker. After all that tree was stationary.

I'm not even sure if an act of God is non preventable anymore. They would tell you that you should of prayed and talked to God before driving to find out what was going to happen that day.
