Accident with alcohol ??

He might get it back in 3 years after all the BS and money that will have to be paid out and classes taken but with a DWI while in a CMV the chances of anyone ever hiring him for a CDL job again are 99.99% to 00.01% unless its a fly by night crook company that can't even get a homeless bum to work for them.

Cab companies hire every degenerate that can breathe. I'm not saying your friend is a degenerate, just a little absent minded aka "Lapse in Judgment."

 

I don't know if this guy is married, has a family, or not. But just thinking what he done, his lapse in judgement, affected his family, his children. How and why?

Well as you know people can sue for anything, most can be chalked up to superfluous suits. However what could happen, and probably should, since this shipper is such a large contract, the carrier should file an action against the driver, due to his actions causing them the loss of this revenue. Yes, I know that there's no way he could ever pay off such a judgement. However, he would be forever reminded of how is little lapse, cost others dearly.

The sad thing about that, is if he does have family, they will probably suffer more than this guy.

The problem is, the first DUI with a hazmat load you lose it for life,with or without an accident.
I had two experiences with DUI CDL drivers, both co-workers. The first one was when I was driving for a grocery warehouse out of Nashville,TN. Management had been notified that alcohol was smelt on his breath by both the customers and the shop personnel and they just ignored the warnings. But it might had been because the company(along with a few other companies) was having complaints from the NAACP for firing blacks unfairly and the driver in question was black.One of the other drivers told me that one of the management ask someone that was an union member to assist him to tell the driver to go for an alcohol test,but there were no union member present as the time. To make a long story short, on a one Sunday morning I was in the office getting my paperwork and I seen that his run was posted on the wall for re-bid. He walked in and I said "look Gerald, they put your run on the board". He went into a rage, screaming and cussing. Even through all of that, I didn't smell any booze on his breath. I went on to do my run for that day. When I came back that morning,I've got the news that he done rolled the truck over in downtown Nashville. Appears that he tried to take a 10mph curve doing 40mph. The cop at the scene told me that he had a blood/alcohol level of .16, four times the limit for a CMV driver.
The second one incident with a drunk CMV driver was with a different company a few years later. He was weaving so bad on the interstate that other truckdrivers was afraid to pass him. So two of them (trucks) block the lanes so to keep the cars wouldn't be in any danger. They called the state troopers on him. From what I was told that cops found a quart of beer in the truck, not good. The irony of it was, when he was hired on. I gave him the road test. If I only knew what would had happened, I would had flunked him.

Go look at 383.51. Scroll down and you will see a chart. First offense with Haz-Mat is 3 year disqualification.

 

If they could just teach reading in cdl school....................
