I realize that any time you can you will bend over and let the government do whatever they want to to you....You have a well known record for loving government intrusion here.
Now....I'll try to explain it to you in simple terms so that maybe even you can grasp it!
I'm not talking about a post accident investigation!
I'm talking about a run of the mill audit where there is no reason to allow them to look at my personal phone.
Is that "outlaw"?
It is not luck....Where I come from they call it skill and experience.
Driving a truck isn't about luck...It might be where you come from.
I do what I should....
But as a free American that sees no need for an anal probe every time I encounter some fleabag cop, I will excersize my right to privacy and make them work for whatever they get!
That will be nothing because I have nothing to hide!

I see no reason why the cops or dot should feel the need to see my cell phone. I agree with Blackw900. It is non of their business. It is also not under the juristiction of the dot. If they want to look at it then they are free to get a warrant, but will need to have a good reason to justify the warrant in order to get one. I don't plan to be one who will turn over and allow them to run over me. I have always cooperated with law enforcement, but won't allow them to push me around and dig around my personal things. Just because someone has a badge doesn't mean that they are in the right or should be allowed to abuse their authority. Frankly, I doubt that any would request to see the cell phone unless there was a serious accident.

The case you mention, is different. The cell phone would have made no difference, it's just a technicality at this point.

It somebody runs a stop sign and plants their head under my trailer. I'm not going to "plead" guilty to a negligence charge by handing them my phone.
As for finding something contained on my phone. Since the actual name on the phone, isn't mine. I #### sure ain't gonna tell them who's name is on it.
Let them get a court order, and hire 150,000 people to sort through the phone companies records to check for tower pings in that area. Then another court order for every phone that pinged that tower during that time.
Then let them interview those people.

I fully agree with blackw900 and wish I could have given you a thousand thanks!. Too many Dudley do rights with way too much time on their hands think of this crap. What would they do to me as I dont handle the phone business, my wife does and sometimes I leave her at a motel while I go and pick up a load and she has the cell phone with her. I know Tazz doesnt have the luxury of staying at a motel so he probably doesnt know how this works.

Your telling me what I think again. Oh goodie. Just love the ignorance that can not define the proper function of government and the improper. Once again you have no right to a public road. You accept the conditions for using it the second you request the privilege to utilize something you do not wholly own.
You are the person whom said it is blind luck to have your accident free record not I. And judging from you bragadocio of out running 62 mile an hour trucks by 20 miles an hour, your belief that the phone in your ear has no effect, your belief that you can" move" people out of your way (though in fairness I believe that might have been your buddy ) I would tend to agree with you it is pure dumb luck. Now you claim knowlege and experience. Huh. Nope sticking with your first premise, it holds more validity I believe.
No cop is asking for your phone. It is not happening and all the quaint fairy tales to that effect just are not real. No one gives one rodent fornication to see your cell phone or whatever questionable pictures you carry on it. But if you feel the need to mislead any investigation(again going off your stories of having a drop phone) instead of standing up for yourself have fun. The immature often expend needless energy on pointless gags. -
Before anybody hammers me on that. It's an app. Simple on/off changes the configuration. GPS....net connectivity...none of it works. It's basically a simple phone until I disable that app. -
