They do. The top bunk is still more dangerous. Due to position- it takes more force in a rollover. Also, think about what would happen should your teammate choose to pass beneath a low bridge...

393.76 (h) Occupant restraint. A motor vehicle manufactured on or after July 1, 1971, and equipped with a sleeper berth must be equipped with a means of preventing ejection of the occupant of the sleeper berth during deceleration of the vehicle. The restraint system must be designed, installed, and maintained to withstand a minimum total force of 6,000 pounds applied toward the front of the vehicle and parallel to the longitudinal axis of the vehicle.
Plus you have individual state laws regarding seatbelt usage. Being in the sleeper isn't an exception. If a restraint is there, it must be used.
I've driven various condo's since 1995 and yet to see a restraint system on the top bunk. One reason is there no need for it as condo's are designed for two people maximum. Plus the injury factor. I've come out of the bottom bunk before and ended up wrapped around the shifter when my trainer locked em up. Not a fun way to wake up. I could imagine the top bunk. I wore the net after that.
