Update on my lease getting terminated. Today I contacted Transwoods Corporate office (Roger Ites) to find they are claiming no knowledge of my termination. From what I was told in the Alice Terminal Office at the time of termination, it was Corporate who made the decision. I then call Alice terminal right after hanging up the phone with Roger and questioned Tina about Corporate not having knowledge of my termination. She then told me she had given Roger the full rundown of what happened earlier that morning. So, Roger flat lied to me about his knowledge. I then asked her who made the termination decision and she finally admitted it came from the Alice office and her boss made the decision. I am now waiting for a call from him that I doubt will never happen.
I went out to the Shell job site today and visited with the Safety Department. I now have in my possession a copy of the report filed by Shell Safety Department. As you can see in the below copied text in the report the driver was not named to be at fault, however, HALLIBURTON had broken many rules as did Transwoods Dispatcher for sending my driver to that site knowing he was not Shell Certified. Therefore Transwood has no legal standing to terminate my lease agreement.
This next part is the text I copied and pasted to this post as reported by Shell Safety Department.

Date: 12-15-11
MVA- SAND TRUCK BUMPED A FLOWLINE BRACE.
In the process of spotting a sand truck on location, the driver was maneuvering the truck in tight quarters. As the driver pulled forward and stepped on the brakes, the truck slid on the mud and bumped a flow line brace with the right side front bumper .Minor damage to the front bumper of the truck and no damage to the flow line brace.
The job was stopped and HSE Tech was called out to location and investigation was initiated.
Investigation Notes:
No safety meeting (JSA) was held.
Driver was not aware of any of our standards or best practices.
Driver was an SSE, 1 week on the job.
No Shell Orientation
Only one spotter. Mix information on the location of the spotter during the MVA. Driver said the spotter was on the driver side of the truck and the spotter said he was at the back of the truck.
Spotter was responsible for the JSA meeting and didnt conduct it.
Hazards of the location were not identified to the drivers.

NOW.....this is not over. I will not roll over and let this company treat me in such a manner. I will prove them as being in the wrong in terminating my lease. I will not go back to work for them as they have now proven to me that they can not be trusted and they are not a honorable company to work for. -
