Fire him. He is working for you. He knows your company name, DOT number, location etc....He could have gotten a hold of you somehow. It sucks about his uncle but even in trying times you cant just forget about all your responsibilities.

Hold the check till he PERSONALLY comes to you. The law does not require you to release funds to anyone that is not the employee. In fact, you can be left holding the bag if the employee ever says they did not receive it and if you cannot prove the signature on the back of cashed check is the employees. Been there, done that. Luckily only cost me $220 in the end.

I had a guy working off and on for me, and before me, my FIL. His mother died and was buried three times in just under 10 years. He even borrowed money from my FIL one time to bury her. She actually didn't die until a few years later, I think. Who knows after this.

Is there any way I can ask for prove or any way to find out if he is telling the truth?

I managed a string of auto repair shops in the 90's and have heard stories that would compare for sure. I usually say I am sorry to hear that and ask where I should send flowers; you know it is BS when they start dancing around the question.stranger Thanks this.

Ask him who is uncle is and where he lived , as you would like to send a card. Then look online in the obituaries to find if the information is true, and he is mentioned.
It sounds like he is wanting to get his check before you deduct anything for his slackness, and you find a new driver. I would be willing to bet he quit and has already found a new job.FreightlinerGuy Thanks this. -
No,too many things happening at once there. Just happened that his uncle died when he arrived at the yard and then the phone died too. AND,he had probably been calling in to some number for three weeks. Just does not seem too likely, but who knows,I guess stranger things have happened.
Like others have said, when you have drivers working for you these things become commonplace after a while. Good luck. -
No, No way he didn't have a way or an oppurtunity to call. This has happened to me a couple times in my driving career and there is a natural thought process of:
1)Getting yourself together
2)Notifing family
3)Getting all the details and making arrangments
4)Notifing employer of time off needed
You just don't completly say to heck with your job.Mommas_money_maker Thanks this. -
Sounds fishy....
Just sayin...
