Mr. Yosya, it is readily apparent that you didn't get the kind of support and compassion you desired. But what did you expect? You and your partner come to this country, continually snub your noses at our laws, and then get mad because you got caught. Learn our laws, and abide by them, and you will have no problems. And us pointing out that we expect you to follow our laws, just like we are expected to, does not in any way make us racist. It makes us LAW ABIDING citizens. Learn the laws, problem solved.

It's not just Hispanics as some would say. Russians, middle eastern, Eastern European. Hell, when I get some from south Georgia it makes me wonder. Just kidding to all my Georgia friends. I always tease a few Georgia Troopers I know telling them they speak a foreign language. Some of the Russians are almost impossible to understand. Like scalemaster said, I could not imagine going to another country, not knowing or being able to speak the language. Let alone have the audacity to believe that the law should not be enforced because he's an immigrant. You know what my ancestors came here from Germany, France and Ireland. You think back in the mid to late 1800's someone would bend over backwards for them. I wasn't around then, but read the history lessons, I highly doubt it. I don't bend over and kiss anyone's arse. I also do not bend a law or look a blind eye to it because it may piss someone off. When a law is a law, it is that way for a reason. Some tree huggers may not like that, well tough sheet. The thing that pisses me off more than anything is when someone doesn't get their way, the want to beech and pout and the first thing out of their cake hole is "it's racist." or "it's because I am ______________" No the anwser to your complaint is you are breaking the law and you are going to be held accountable like everyone else is. Ok, quick ENGLISH lesson. It's "ignorant", not inorant.Sounds like you your saying " In o rant" Which I think you are. Your on a rant that got quickly derailed. So let's play devil's advocate. Your complaint is being able to speak English and beiong placed out of service. The next guy is beeching that he thinks it's oppressive that he is held to 11 hours of driving time. Now that I placed him out of service, I am discriminating against him because he knows his body and he operates on 4 hours sleep a day. I'm holding the man back and keeping him from making a living. The next guy thinks he is the best driver in the world and even though his tires look like NASCAR racing tires, he has the physical ability and wheel control to handle a tractor trailer with slick tires. But I'm "IGNORANT" towards him because when I enforce THE LAW, he has to park the truck until he fixes the tires or takes 10 hours off. Where do you stop? Hell, it's a free for all, you driver's just do whatever the hell you want, because you are living the AMERICAN DREAM!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
That's an analogy you might understand to your situation. I feel bad for your partner, but I don't make the laws, I enforce them. When it's in black and white, it is very clear what I have to do. There is no gray there and instead of you crying a river that no one wants to hear about, how bout you help your partner learn the language. That way he can legally get back to driving. -

Too be totally fair, I find it amusing that so many on here are taking such a hard stance of follow the regulations or don't drive. It would be interesting to read your other posts to see your feeling for the hours of service. Don't get me wrong, I'm not saying the regulations shouldn't be enforced, I just happen to think that they should all be enforced.

i'm just wondering how far he can go, but must be a one heck of dv were he lives, i thought you went thru a seris of test at your dmv for any kind of lic, car-18 wheeler ect, they do in Ia anyway, thats why this a good reminder post of the regulations, as needed for the public safety, and then you go the hospital and go pp in the little cup and read and understand english and stuff, too get the medical card, so he must not have that ether, thats why this post is made by the author is a anthor kids tale , too get the truck drivers all stirred up , as were not stirred up with our daily grind of everyday work, so somebody really bored the heck out the in trucker land in his truck sitting at a truckstop .

I have asked that question before at my DMV before. They give the written test in multiple languages. I asked why, so they don't discriminate. Someone might be able to minimally understand but they are more comfortable in the native language. I don't have a problem with that, as long as they can minimally communicate and read and understand road signs. But like scalemaster said, when you ask for something or request something, all you get is a head nod and a smile. Or you ask to see the fire extinguisher and the the driver opens the hood. Or you ask them to step on the brake pedal to pump down the brakes to check the low air light and the jump out of the truck and open the back doors. These are some of the things I have seen unqualified driver's do.
Do I place one everyday out of service? No, Have I placed them out before? Yes. Here in the last six months I can't remember having any. I have had a few that were close. But the driver was able to do everything that was asked of him. He was able to understand what I was asking as far as inquiries. I'll give the driver a lot of leeway and take my time. That way, if I place them out of service I can say without a shadow of doubt I gave them every opportunity and I can show why they were placed out of service. It's the same prinicpal I use when dealing with 392.3, fatigued driver. I don't do that very often, but when I do it's for a reason. LAst week right before Christmas I had a driver that when I stopped him could barely keep his bloodshot eyes open. His speech was slurred, incoherent at times. I thought he was impaired. Did field sobriety tests. I ran through some of the things I do when I do Drug Evaluations on an impaired driver, and nothing. I knew his log hours were long at first glance before I did those tests. After I determined he was not on anything, I examined the logs a little closer. He was into his 32 hour since coming on duty. He took a 1 hour off duty period. He had 18 hours of drive time, and the rest was on duty not driving. I went back up to the truck to ask questions about where he was, he was slumped over the wheel out. Beat on the window for a few minutes before he awoke. He was placed OOS for fatigue. He was the 1st guy I had done that to in 4 years. The last being a guy that almost struck my cruiser and then me when I was on the side of the road on a traffic stop. The point being it's not something that happens daily for either thing. But the law is the law. It says you shall, which means you will, period.
