The scenario described by the OP is that of an employer/employee, not of a contractor. Any tax savy accountant, tax preparer, lawer, business person will confirm this.
Just keep in mind that when the tax man cometh he drives a bulldozer. -
Thats right and with what a previous poster stated about 1099'ing, you can
Rent/ Lease a truck to a driver without all the extras. You need a written document/contract to amke sure it's clear from the start. Being a contractor has it's benifits too, just like being a employee may? (it's been so long I wouldn't know). The question I put forth would a man be beter off with a 1099 income or no income? -
There I fixed it for you. In my opinion the most visible differentiator is that you define the worker's schedule and tell them where/when to work.
Unless you rent them the truck then offer a selection of loads to take with no consequence on the choice, you have an employee.
The risk is not worth the savings. -
I have worked Logging Truck for years on a % of wood I deliver to the mill each day ! Some days were good , and some I worked ALL day and made NOTHING!!! my choice I chose percentage !
If grandma has 1 Truck , the best way to make a $ is to 1099 based on a contract with someone ! HEY I might even jump at it if the % appeals to me.
Remember the IRS is only a collection agency (a private company) to collect taxes for congress . And Congress works for me Congress did not appoint IRS as my boss. I will do as I please as long as I dont injure anyone else. -
While I agree completely with the sentiment.. ..it's unfortunate that you'll likely not find any sympathy from a judge.. forget about jury nullification because the jurors pay their "ransom" and they're pissed that you aren't. People go to prison for it every day. In this police state we live in anymore it's well known and documented the IRS does troll the internet.VisionLogistics Thanks this.

Oh yah....cpm rate, right? Regardless of what anyone says, YOU are the owner. How YOU decide to do business is up to you. Be fair and honest.....or be like some of the big guys who have lost what it was to own/drive a truck.
If you have a driver, talk with him. Find out what his needs are. If you can meet those needs, even in the slow months, great. If not, TELL him. Do not make empty promises just to keep a driver. You both will be better off. -

Just kidding Rick! Seriously, she did ask about cpm, just for empty miles. And I stand by my suggestion of fair and honest treatment for her driver.
