My husband met a school recruiter and off the bat he said he turned away a lot of applicants due to their records. He is very picky and only accepts "employable" people for CDL training. Being you must get hired first for a comoany before he will accept for the school, he puts in apps that you are not required to work, he says is a pre-hire, no commitment. We liked him though, nice guy, a little spendy but he is the only one in area with financing.
We ran into obstacles immediately. My husband barely got his resident card last May and took months to get a drivers license as in state of MN they require a 3 month wait to get a DL after passing written test. Shortly after obtaing DL, he got the CDL permit. The school says you MUST have had a DL for 1 year or personal driving experience. My husband told him he has driven since he was 14(he is 39) but due to his status he couldn't get a DL in U.S. And in his country of citizen his area didn't require having license.
Next obstacle, the school called and asked if ever had a DL cause they saw on his record he had a DUI from 1998. He said yes is true though he was not legal at time. it is linked to his DL # I am guessing shouldn't have been a problem being the DMV never said anything when applied for DL. What can be dome now? Should he just wait for 1 year to pass or is there alternatives? Are all schools the same with this rule?
Another question, if he applys in another state will this be a issue?

I'm not sure what you are saying exactly.
You are saying is that your husband had trouble with a school he applied to because of a DUI from 1998 I get that part, but what do you mean when you say he wasn't legal at the time? Are you saying that he wasn't a U.S. citizen at the time?
Y'all may want to check with a lawyer to see if there is any legal recourse regarding that issue.
Now when you say apply to another state what do you mean exactly? You mean go to a school in another state or something else? -

They are very strict with their applicants. There are also limits to what he can get for financing. Since he must be a resident of the state for ( I think ) one year, maybe more.
Yes, your husband should wait a year to gain experience driving, under his new DL. The school is concerned with your husbands DUI, as that is a big red flag for many Trucking companies.
This could limit his employ-ability, and will affect their ability to make their claim's about student placement. -
Thanks so much for responding and sorry if i wasn't clear, i too am confused, lol. My husband was illegal in U.S, for many years and unfortunetely had some issues while illegal here. He went through the immigration process for 3 years and got his green card last year, the immigration is full aware of all his records in U.S., one being the DUI from Minnesota in 1998. He is clear on that. But now that he is back in MN legally, he is wanting to attend a trucking school and they are asking about this. Also they say he has to have 1 full year of having a drivers license. I guess I want to know if this is the same at all schools. I don't think that DUI would be a issue gettinga CDL since it is 14 years ago but just wondering anyways.
The reason I ask about other state is if he was in another state would this DUI be a issue there as well? He was already looking into going to another state for trucking school as the ones in our area are very expensive and when he gets the CDL will be looking for work in other state anyways. Thanks for advice, is what I was thinking and fear having to wait one full year. So if this DUI is 14 years old it is still a red flag?
Also what about if he goes to oilfields he has the cdl permit now, would this be issue being he could gather experience, pass time until a year passes then apply for CDL? -
He could go to a school in another state. The usual procedure is that you get a CDL for the state that you go to school in and then transfer it to your state of residence. You just have to make sure that the school that he goes to will take out of state applicants. I believe you are given 30 days from the date you get your CDL to transfer it to your state of residence.
It depends on the company. Some companies will not hire you if you have a DUI on your record and some companies will if a certain amount of time has passed.
If he is absolutely set on working in the oilfields he should contact the companies that he wants to apply to and ask them directly if they will consider him with a 14 year old DUI.
Also an attorney might be able to help him get it expunged from his record. -
