I agree AT....those little box trucks in particular offer zilch in terms of protection (especially at highway speeds), and it doesn't matter if you hit someone from behind or get hit, as it appears this one did.

Wow. Bad week for Schneider.
If the guy was getting directions, dialing a number, texting or turning his phone on, the witness statement says he had the phone in his hand. It no longer matters what he was doing with it. If it can be proved he was doing anything with his phone, his goose is cooked. -
How far off the shoulder was the truck?
-
The phone records will be pulled to see what he was or wasnt doing, either way.Bad deal all around.I hope the driver wasnt doing that.
-
Would the same be true if he was fiddling with his GPS?
-
That driver hit the box truck square on. Look how the CAC is pushed all the way up. It wouldn't look like that if he just clipped him.
-
In the eyes of the law, distracted is distracted regardless of the electronic gadget or other article in question. However, there is specific language in place for phones. I'm not exactly sure how this will play out if he was programming a GPS.
Another good reason why I don't have one. -
Sni is tough on safty and that driver went thrue every class i did about distracted driveing no excuse for it and nothing is that emportant to kill someone over
