Hey WCP... the prob were trying to figure out is why would one of the posters get a CVSA sticker and a fine at the same time... thats whats confusing...

 

For Cali based carriers....That decal is is usually a "Reward" for passing a BIT Program inspection...

TTBOMK......If you pass an inspection....There are no fines issued.....

Can you post word for word what the paper work states?

 

Do not...Again Do Not accept a Warning from any DOT officer if you receive an inspection....If you receive a warning as a result of an inspection...Insist that the officer write up a citation....I know this sounds weird to most of you but there is a good reason for this....Provided that you believe the "Violation" is unwarranted or incorrect...

"Corrected" issues that were the result of a warning cannot be "Data Q-ued"...Citations can be "Data Q-ued" that is....After the carrier receives the citation, and then "corrects" (Proves) the violation received was in error.....The carrier can then "Data Q-ue" the citation back to the issuing officer who then, based on his determination can have the citation removed from the CSA records....

Let me give you an example....

Say you did a pre-trip and recorded that pre-trip on your cell phone's video.....
You cross a coop and get pulled in...DOT finds that you have a head lamp that is out on an L1....
Even if you told the officer that you pre-tripped and found every thing serviceable....Because the way the laws are written in some states...Even with your notation on your inspection report...The officer will have to issue a warning or a citation....
By asking for a citation you can then have a court appearance with a judge and the officer....Then you can present the judge with not only with your inspection report...But also the video of your inspection....Most cell phone videos these days have a "Time Stamp" to verify when the recording was made....
In most cases like this...The judge would rule in your favor and recommend the citation be thrown out....
Based on that...The carrier can then Data Q-ue the voided citation..The officer would accept the Data Q-ue challenge...Then the CSA scores would then be adjusted to reflect the successful challenge....

 

What i was saying is it does not matter if you have the sticker ...i got one at banning scales and got hit with a dot inspection in Alabama at the super coop...I understand that for cali carriers its a gold star but you can still get inspected plain and simple

 

So basically its just court costs. Another way of California making sure they at least get some money from you. I'd pay it and go on if not I think they'd make it worse.

 

Sounds to me like he got the fine for one of the violations he had road service fix. After he had it fixed he got the yellow sticker. Same thing happened to me. I got a warning at the bug station on 40,very fair lady BTW. She found a cracked rim but letme go on into Needles to get it fixed. I stopped at Tehachapi to have it signedby the scale master and he put the yellow sticker on my windshield.

 

I've lived and trucked in California for 25 years. It's because you had a correctable violation, also known as a "fix-it ticket". The $25 is a fee paid to the local county court to process the paperwork, not a fine for the violation. You received a current CVSA sticker on your windshield because you passed the inspection after the road service truck fixed the violations on your truck. I would not recommend removing the sticker until you get inspected again and receive a new one. Having no sticker at all is just begging to be pulled in for another inspection, especially if you are an out of state truck. Having to call road service for a minor repair is much more detrimental to your profit than the $25 court fee. Do better pre-trip inspections, and keep your truck maintained and legal.
