I can only imagine the frustration and anger you must have felt.
For what it's worth though, your story made me feel good. Not because you were dealt a raw deal, but because of the final outcome. It's about time SOMEone stood up and said "I ain't gonna take any more of this bovine excrement". I think more folks should do what you did, --- take 'em to court. There's too much abuse associated with DAC reports and it's pretty obvious some Big truck truckin' companies use it for get-evenism for any reason, business related or personal, -- factual or fictional, which can have very negative effects on those who have been falsely accused.

I couldn't agree more with the findings of the arbitrator in this case, a classic example of a reckless, malicious, wanton disregard for the resulting defamation. Some people can't be trusted with the power vested in them by the company they work for. I suspect there are times when the heads of companies aren't aware of the antics of those who tend to abuse the power and ability associated with their job. Bottom line though, --- the Big truck truckin' companies can be held responsible for the actions of their employees, and re-actions that result from those improper actions.

In my opinion, anyone found committing such an offense should be banned from holding any job that includes making decisions concerning others, and any offenses they committed in the past should become part of their permanent record that follows them and must be disclosed on any and all applications for employment in the future. Treat it as lying under oath with the same punishment.
Jail time?
Sure! Why not?

As it stands now, DAC reports are a joke due to the number of false reports of wrongdoing. Doing wrong is too easy and punishment is almost never included when a report is challenged and found to have merit. It's kinda like, OOps. Sorry 'bout that. No hard feelings, --- and that excuses their intentional transgressions.
Mistakes are one thing, intentional acts are quite another. If those prone to committing such acts aren't persuaded to do the right thing by common decency, hit 'em where it'll hurt 'em the most, --- smack-dab in their wallet. Make examples of those who practice deception and publish their names and the punishment they received for their undesirable actions. Unless some drastic measures are taken, I think this problem will continue and probably increase.

I hope y'all are doin' better now and that the ordeal you were put through is behind you, --- over and done with, --- and that y'all never have to experience anything like that again. Thanx for standin' up and exposing those responsible. Maybe if more folks took false accusations to court the powers that be would do something to eliminate the ability for one disgruntled person to effectively ruin the reputation and career of those who they falsely accused.

Give some people a little authority and power and it goes to their head and they can't resist the urge to overstep the boundaries that decent folks observe.

Now that you've found this website Shirley, don't be a stranger. I'm thinkin' y'all have a lot that you can contribute here. And I bet you'll find things of interest here as well.

 

I don't know how these career OTR guys do it. I did it for a year, and that really made me appreciate dead end factory jobs more. Like I would deliver to some warehouse, and I would envy the guy loading me because he got to go home every night.

I mean you might as well go run off to Alaska and live out in the woods. That's how much of a life you have when driving otr. No time to make friends, or have a relationship.
At a certain point some things become more inporntant than money. Now I'll go stock shelves in a grocery store, happy to be going home every night.

 

Some of us are wired differant.

Me and the wife enjoy my schedule. I work 2 weeks on, 1 off.

Moving to a factory, retail store, or local driving job would actually BE WORSE than driving OTR.

What other job offers me this kind of flexibility ????

This is true. But all one has to do, is look for the job. Many companies are now offering modified schedules. We have a half dozen or so. And I know of at least 3 other "big" companies offering the same.

Most would be considered regional. I'm not really sure where mine falls, since I "can" do the lower 48 and Canada in those 2 weeks.

Not the entire 48 in 2 weeks. But I can hit ANY of them in that 2 weeks.

 

Well,I would like to say one thing about TMC,and US express. Your loss peeps,I was with my last employer as a sub contractor and served them in a very loyal and professional manner for 13 years before deciding to become a truck driver.I even got sub contractor of the year in 2004. I can't change what I did when I was a teen and that is why you turned me down.All I can say is I paid my dues,my debt to society,turned my life around and am a better person for it.I can't believe I was turned down over something that happened 18 years ago.
The company that has decided to give me a chance will not be let down,and I will more than likely work for them as long as humanly possible,or until they decide otherwise. Also will give my ALL every day to do my best and represent them in a professional manner. Thank you Howard Transportation for giving me the Chance!! I truly appreciate it and I will do my best NOT to let you down,and hopefully will retire with you! I do understand with anything you do you have to pay your dues. I have heard great things about Howard from my instructors and look forward to being a part of the team.

all I can tell these companies, is, "if the truth hurts" then change

 

screw it lets all go on strike

 

our society is not very forgiving, once you get a felony on your record, its all over. Your never getting any job better than being a construction worker after that.

Once you go to jail once, might as well just give up, because the deck is stacked against you.

Hell, even being unemployed stacks the deck against you, when looking for a job. It's a vicious cycle, the longer you go without a job, the harder it becomes to get hired. Then your just done for.
