wrongful dismissal

    I was fired from Paschall Truck Lines on 09/21/07 for refusal to take a drug test but the staff at the Primary Care Clinic refused to give me the cup to pee in. They must have falsified the drug testing form. I reviewed the Incident with Kentucky DOT Officer Townsend who works at the I-24 scales and he agreed that I could log the incident as a canceled drug test which should have resulted in no firing or screwed up DAC record at PTL. FMC Safety Regs 40.207 specifically prohibits a driver from being fired for a canceled drug test which I tried to inform this arrogant college boy safety director of John Hayman at PTL. (Hayman chose to ignore the safety regs probably because the employement law in Kentucky is very favorable to employers) Since my firing last week Friday I have been in contact with USIS Transportation Services and they faxed me a medical release form which is on it's way back to them along with photocopies of my logs, hopefully I will get this falsified drug test report disputed quickly. I also contacted my US House Rep Timothy Johnson about this but explained it as a Contempt of Congress Case. I am not the only one getting screwd out of money so is Congress. The girl by getting me fired is quilty of impeding interstate commerce and the proper taxation thereof. If she thinks she can screw Congress out of cash that's rather contemptuous. I need help getting a lawyer near Murray Ky that handles DOT or wrongful dismmisall cases. Most of the lawyers in Murray have conflict of interest excuses because they don't want to piss off the owner Mr. Waller. I need some help guys, I need a real mean S.O.B. lawyer on this one.

    Something stinks here... I can think of NO reason why a clinic person would refuse to give a piss cup to someone that has been sent to them by an account holder which had probably pre-paid for the drug screen anyway.

    Could be he signed in to take the test and after signing in, but before taking the test, he left the area for one reason or another, and tried to come back. Which in all drug tests I have ever had is a no no. But that is just a possible scenario, not saying that is what happened.

    Something doesn't sound right. We need more facts about it. I wouldn't have left until they gave me a cup to pee in.... If they still refused I would have pee'd on all the walls or the floor until the cops came and then at least they would see it wasn't me that refused, it was the clinic. But then again, I may look like a nut for peeing everywhere. Could have at least called in to the boss and said, "Hey... these guys are refusung to give me a pee cup for my drug screen.... help."

    Exactly...I wouldn't have left for any reason once they refused to give me a cup. I would have been on the phone with my safety department, dispatch...anyone to show that it wasn't me making the boo boo here.

    I would never have left, my cell phone would have been busy for sure.

    I have never encountered a time when they did not give me a cup. Lord knows I've been peeing in them for years...sigh

    Side note, ........... there are places where folks have different accents. Is it possible the clinic thought that driver was requesting a "pick-up" (pee-cup)?
    Could be either a small 4-wheeler truck or a date.
