Why would one want to take a chance on his driver getting hurt and not be insured? What is a driver and his family to do if he is seriosly injured and can't work and can't afford the medical help he needs so you can make a few more dollars? Trucking is a business and needs to be run as one.

I'm not trying to find someone to agree with me. Actually its quite the contrary. I already spoke with a insurance agent today for a quote on WC, I'm having all the guys sign W2's, changing them to mile pay, and I'm reporting myself to the IRS so I can pay the back taxes on them without waiting for them to audit me, so I won't have to pay fines and they are going to work out a payment plan for me. I was just letting you know what my accountant told me. She really did contact the IRS and the person she spoke to really did tell her that. They told her to put in a formal request to the IRS for classification but it can take up to 90 days to respond. Believe me, I take wisdom. All you have to do is tell me that the stove is hot, I don't have to touch it to learn! lol

I don't know if I'd report myself to the IRS (in case you haven't already), but you are definitely doing the right steps that should you be audited, to have some leniency thrown your way. Good luck to ya.

I agree. you only have to show you have taken steps to correct the wrong, and probably just settle this first qtr rather than last year. Consult a tax attorney, well worth the $500 i paid.
