MO DOT just yanked my chain

    (1) Use alcohol, as defined in §382.107 of this subchapter, or be under the influence of alcohol, within 4 hours before going on duty or operating, or having physical control of, a commercial motor vehicle; or
    (2) Use alcohol, be under the influence of alcohol, or have any measured alcohol concentration or detected presence of alcohol, while on duty, or operating, or in physical control of a commercial motor vehicle; or

    Seems to me you can have a drink as long as you quit 4 hrs before going on duty.

    True, but you are in "physical control" of the truck while on your 10hr break unless you are on line 1 and away from the truck.

    Also, I have been told that if the key is in the ignition or the truck is running, then it is a DUI same as for a four-wheeler.

    It is a blue Wetern Star Lowmax, and I'm currently on the road, but usually it can be found sitting in my driveway..... I'm not worried about it being stolen. If they really want the truck, a locked door is not going to stop them at all. Of they really wanted to take the time to search for a key they could, but breaking a window or picking the lock would be much faster. Heck, I have used a slim-Jim to get into it and took me about 2 minutes. They reason for the extra keys is that I locked myself one night and called a locksmith, he came with his ba of tricks and I asked to see the slim-Jim and got it open myself, of course he still charged me $75 LOL

    let's remember we are held to a higher standard once they pot CDL on or license. On duty off duty in our pick up truck the limit is .04. Of course I been going to AA for 11 years I drank up my quota in my youth

    you could have just put a quarter in his airline and no one would have been the wiser.

    some are of the opinion you cant take a drink at all, but that isnt true. you shouldnt have it in the cab but the sleeper is a different story.

    in fact many companies have a policy on such things. our is they prefer not at all, but if you do in the sleeper only or out of the truck.

    question here, if this had been a owner/ operator of this truck, would you have called the cops until you knew his intentions of driving or not?

    hard call either way.

    I would not have cared if it was the Pope all liquored up on holy wine, I did what I thought was right. And he was an O/O according to the officer

    There's a big difference between having a drink and being drunk. Not to mention urinating in the parking lot.

    If you are locked out at a truck stop, just grab a wire coat hanger from the mechanics locker room. Ask them first! Ya know they have those rental uniforms so they have tons of those hangers.

    I can pop a FLD lock in 10 seconds with a coat hanger.



    So my little story this week:

    I come down and around this drive for a delivery with employees cars parked all along the curb and corners like they do in NYC.
    I come down to the end to turn into the rear of the property and I just glimpse a blue Pete bouncing up and down on the scale. He jammed his driver side steer up against the guard rail and it was trying to mount the rail, lug nut covers were flying everywhere!

    So the jassack company has everything blocked and the only way in and out is over the scale. People come out and now it's a big deal this Pete driver crashed into the guard rail on the scale. Paperwork must be filled out, pictures taken. Sheesh!

    Ok now it's time to move and the Pete driver is empty and wants me (loaded) to back up around corners with four wheelers everywhere so he can get out! He could very easily back straight over the scale into the open area where he just came from so I can pull in there too and then he can leave.

    We get into an argument.

    He says he's not backing up and I have to do something.

    I say "where I come from loaded trucks have the right of way".

    I ask "How hard is it to just back up straight over the scale where there is lots of room?" Then I say "oh I guess that's a stupid question since you can't even go forward without crashing into the side!"

    So I end up squeezing into this little gap in the cars where he just gets by me.



    So yeh, you need more than just a good looking Pete to impress me!

    I also noticed his trailer wheels had all freshly scrubbed sidewalls and his toolbox doors were scraped too.

    I'm pretty sure this guy's name was just on the payroll and not the title!

    Even the forklift drivers where making fun of him to me!

    While you may agree or disagree, the regulations are very clear. no alcohol can be in your system while you are in control of a commercial motor vehicle .

    Don't agree, think the regulation is too harsh. Fine, work to get it changed (good luck with that one).

    And if you decided that you don't agree and are not going to follow it, do it with the full understanding that you are responsible for the consequences of your actions. Not the driver that may report you, or the person that watches you put that beer from the truck stop and makes a call.
