Team Drivers and Border Crossing

    I am a team driver for a company that requires traveling into Canada and back across to the US.
    I am having a difficult time findind a specific answer for a duty status. Since a driver must be present in the fron seat when crossing the borders, is this logged as on duty time for the driver that has to be woken up and be present to answer questions by the border agent? I'm thinking it does but I need a very technical answer. Please, if you know the answer guide me to the requlation in the DOT HOS.

    If the driver goes to line 4 while at the border, under the recently changed rules, the co driver can be off duty in the right chair. If the driver stays on line 3, the time in the right seat must be immediately before or after 8 continuous hours in the sleeper. Co drivers are not always asked to present themselves to the agent, as long as their ID is available. Just my opinion.
