Where do you guys come up with this stuff ? If a CMV is over 10,000 lbs. you have to have a medical card and log book . You can use an unladen CMV while off duty but it is still a CMV , not your personal vehicle . As east bound and down noted F-350's have to cross under some circumstances . I worked for a company that had F-350 crew cabs . Several drivers were allowed to drive them but once they hooked up to any kind of trailer only drivers with medical cards could drive them .

yes, I realized after I posted that the 26k lb rule referred to gvw not actual weight. I still think when bobtail with no load and if not under lease or contract, you can be considered using your private vehicle, tho still required to pull into a scale. Thnx

yes you must enter but are allowed to cross the empty lane if provided if not you have to cross the scales and all driving time must be recorded correctly.

even using the no laden rule you must cross the scales. but if your father is heading up to pick up trailer that is as good and being preplanned as he is being sent up to the other state to get something for the company. the rule simple states you must not be laden with a load or preplanned a load . no heading to pick up a load (in this case the trailer) to be on compliance.

psu ask yourself these questions. one can you off duty drive for your company. eobr will have a place for you to put this on your logs. two, am i preplanned on a load or heading to pick up a load or trailer for my company. third am i heading home for home time empty. if you answer yes to the first and yes to third but no to the second you are free to off duty drive all the way home. but you still have to enter a open scale house.

Even as a bobtail it's still a laden CMV because you're dad is driving to a shipper. Your dad also needs to continue logging as normal. Driving to a shipper needs to be on line 3.

In my state, unless you have "not for hire" on the side, you're under HOS rules. DOT doesn't care if you're being paid or not, your still DRIVING! When in doubt cross the scales!
