Back in HS I had a friend who was traveling down the left turning lane because the single straight lane was backed up. Up ahead in the straight lane was a nice-guy citizen who had noticed a gal trying to turn left out of a parking lot, he made some distance for her to get out and then waved her out.
Nice-guy forgot to check his left mirror.. my friend Tboned her and put her in the hospital. To make matters worse she was a professional dancer for the local NBA Team. I believe it ended her career.. anyway..
The Judge faulted the guy who waved her out citing that once you make ANY indication that the way is clear for another driver you are ACTING AS A TRAFFIC CONTROL DEVICE and assume any liability for what occurs following that act.
SO.. point being.. I think this rule/law changes state to state. I personally will never "indicate" or so much as make eye contact with the other person. I will however leave a sufficient gap and it's up to them to determine what is safe and what is not. -
I think that is pretty much taking it to the extreme. You have to use common sense in your actions. How do you get through life without making eye contact with everyone. You are right saying "it's up to them to determine what is safe" but just because some people (the nice guys) have made mistakes should we throw courtesy out the window?

Clarification.. when I'm being "the nice guy" I won't make eye contact in that situation.
Eye contact is usually followed by some sort of "can I go?" gesture.. which is followed by a nod, wave or something which may or may not get you in trouble.
IMO Better to not even go down that road.
My "courtesy" is leaving a gap and delay in moving that any reasonable person would imply as an OK to go. It's not that I don't always strive to be courteous to my fellow man.. I'm just not willing to open myself up to prosecution as a result of it.Last edited: Apr 1, 2012

I guess this is when those on-board cameras would come in handy. No arguing with video of the guy shooting across the lanes into the other truck.
