16K in damages is CHEAP.
I know a guy that hit ONE cow and just got his truck back. $18,000 repair bill. -
When I was in South West Asia you would see cars that were top speed and hitting herds of camels crossing the roads!

Sure hope the state is better at containing the inmates that milk those cows. Next thing to happen here is an inmate stealing a car from a local farm, then the state blames the farmer for the robbery the escapees commit because the car was not insured for theft.

His only savings might be to convince the court that he said he was going 58 in his truck. Then try to explain that 58 on the truck is actually 55 ground speed.
He should never had said what his speed was. The difference was minimal.
Now, if this had been a local farmer whose cows had got out, the farmer would be responsible for damages. Since the farmer in this instance is the state, they will do anything they can to avoid liability. Get an attorney.
I can't believe a judge would let the state get away with this. No truck can stop within 10 feet at 55 mph. The difference in the stopping distance at 58 is not material. -
One thing I learned from my daddy on my 16th birthday. We were on our way to get my driver's license and dad had been training me for the road test all week, I remember it clear, I was excited as could be.
When we got to the dmv we sat for just a minute and he said there was one more thing i NEEDED to know about owning and driving a car.
"Boy, if you ever crash this thing, you don't say a word. Get insurance info and whatever else you need to, call the police, whatever. but you don't say a #### word."
Never talk about fault in an accident. Never say you were in the wrong, Never EVER. Cause if you make it sound like it might have possibly in some small way have been your fault
they'll blame YOU. -
I can't see anyway that a judge would put this on the driver. The state did not maintain it's fence, had the fence not been rotting the cows wouldn't have gotten out!
