I worked for a company out of Chicago and my boss tried to strand me away from in Kansas City without having a way back home. I was told by text message Tuesday, May 8, 2012 that the company, US Logistics Inc, I worked for will be shutting down on Thursday, May 10, 2012 and told I would be bring the truck 130 and trailer 253533 back to Chicago, IL, the dispatcher and owner of USA Logistics Inc. I was located in Kissimmee, Fl at my second drop after bring the load from Dallas TX. I was in truck 130, a lease truck from Pac Lease in Hickory Hills, IL, make of truck is a Peterbilt, the color of the truck is white. and model is 386. After the load was drop, I went back home to Moultrie, GA to rest and get ready for my trip to Chicago and maybe get ready to go to another company as my boss told me through text messages. I was told I would be paid for all empty miles on this trip by my boss. I lefted Moultrie around 11:30 central times and went to Tifton, Ga to fuel up at Pilot travel central and started heading to Chicago. The Secetary for USA Logistics inc. sent me a text messages telling me to go to Kansas City to drop the trailer off, before coming to Chicago. At this point I asked her what happened to my check being deposited Tuesday and she told me that they have change accounts and my check would be up there in Chicago. I stopped in Kentucky at the Huck travel center off I24 ex 40. I spent the night there and took my 10 hours break there.
After getting up the next day on Thursday of May 10, 2012, I went about 120 miles to Mount Vernon, IL and stop at the Pilot travel center off of I57 and I64 ex. 95 to fuel up and get something to eat. I enter my necessary information to fuel up and find out then the fuel card was off and more than likely I would have problems with fuel and sent the secretary a text message telling her the fuel card was off and more than likely we would have problem. she didn't return my text in a timely fashion and after I went another 120 miles toward O'Fallon, MO on I 70 I seen a Peterbilt dealership, and decided to see if I could get some fuel from there and lets Pac Lease from Hickory Hills, IL know what was going on and to tell them what was told me on tuesday by text messages from my boss, which I did. I found out that this Peterbilt dealership had no way of providing me fuel. Ron or Ronnie the person from Pac Lease Hillory Hills was acting like a Prick and talking like I did something wrong by calling him. He told me to go to the service area and asked for a person working there( I forgot the name of the person he told me to asked for) and service technicians told me to go and talked to Dave in Pac Lease and a woman but she wasn't at work that day as I did and dave told me basically the same thing that there nothing he could do. I don't know what Ron or Ronnie was doing but he did called me back and asked for Frank's number and told him at the time, I didn't have it because I didn't want to be bother with him no more since there was nothing he could do for me and acting like a prick in the first place. I went a few miles down the road and the secretary called and told me to stop by a truck stop so she could used a credit card over the phone and get some fuel, but I was told at the Travel center of America off i70 ex 203 that they had a policy that don't allow them to do that. I text her back and told her that and I was prepared to stay there until I get some fuel.
I got about 50 miles down the road, owner called about 1:30 or so cursing and fussing at me for calling Pac Lease about the company being shut down by DOT and to get fuel. I never cursed him or said anything bad to him, but after he told me to pay to put fuel in the truck, I realized then, there something funny about this and knew then, I would get paid nothing and my best bet was to take the trailer back to Kansas City and think about what to do next, which I did. After taking a nap and relaxing for a few hours I went and got me something to eat from the McDonald's off front st in Kansas City and then decided to called Pac Central, an enity to Pac Lease and Peterbilt and told them I was about run out of fuel and I need some fuel. MNC KENWORTH of Kansas City put exactly 29.4 gallons of fuel in the truck and I knew then, I wasn't going to Chicago if I had to put fuel in the truck since I was a company driver and was going back home. I had to much stuff in the truck to catch a bus and decided it would be cheaper to put fuel in the truck and go back home and allow peterbilt or Usa Logistics come get the truck from Moultrie, Ga where I live since I was still responsible for the truck if something happened to it if I left it somewhere. I added about 25 gallons of fuel in the truck at Oak Grove MO and another 25 gallons at the Huck Travel Central in Kentucky off I24 ex. 40 before being falsely accused of stealing the truck. My boss, called Pac lease and lied to them that I took the truck since I was heading home and not to Chicago. I like to know what I can do about that since I had to put fuel in the truck as a truck driver since, I wasn't a lease operator or owner operator, it isn't my responsibility to put fuel in the truck and drive it to Chicago, knowing I wasn't going to get paid for it and more than likely I would have to buy a bus ticket back home.
I have all my paperwork that will show I had the right to be in the 386 Peterbilt, on 5-11-12 and that my boss had stolen from other drivers before and hasn't paid them their last pay check and own drivers over 15000 thousand dollars after they left the company.the same problems with my boss and he tried his best to make it hard for these two drivers also. Mr. Kinley contacted the police and told them what was going on and they said if the owner refused to get him home he had the right to going home and the owner could come and get his truck although he was responsible for the truck until my boss comes get it.

I was looking to become an owner operator in the near future and had no reason to steal the truck in the first place and I let my boss know this a few weeks before and I had no reason to steal the truck but was trying to get back home because my boss was trying to strand me almost 1000 miles without paying me my last two paychecks, my escrow for a $1000.00 and all empty miles for taking the trailer back to Kansas City which he stated he will do. I had no reason, to believe he would pay me my paycheck when I got to Chicago or even helped me to get on with the company he was supposely going to Global Logistics because another Driver told me that company told him they didn't have no more trucks and he had to looked someone where else for another job and the reason, I decided not to waste no more time with boss and head back home where I was on Wednesday and allow him to come get his truck if he wants it. I thought my boss, had my best interest at heart, but it turned out he was only using me to get the trailer and truck back where he needed it and he was going to strand me in Kansas City or Chicago because he didn't want to lose no more money with his trucking company and he didn't care whom he hurts or destroy to do this.
My Psp score which the Federal Government keep up with was already bad because of this company and it is a direct result of my boss not taking care of his equipment although I for one made sure if something was wrong with a truck or trailer, to make sure he knew. He would always tell me to tell him what was wrong, but he will never fixed what needed fixing until it broke down, or we went through a weight station and was put out of service until the problem was fixed. But I stayed with him anyway because he gave me an opportunity when no one else would, since I was out of the industry for more than 8 years and didn't have no overroad experience.
Hopefully someone out there know the law and can helped me, a state trooper in Tennessee, stopped me and I was charged with theft of property over $10000-60000 which is a class c felony in Tennessee and carried sentence of 4 to 6 years. I was trying to do what was right by my boss and his company but realized a little late and almost a 1000 miles away from Home I between a rock and a hard place. I didn't know what to do so I did what I thought was in my best interest and in a world of trouble as I speak. I go back to court in July and really need some advice and helped although I have an attorney, I am trying to see what else I can do or there any laws out there that protected drivers from being strand by companies while on the road. I know, but when you don't know no better sometimes you do stupid stuffs and I did a lot of stupid stuffs without thinking. But I did one thing right and that was give it to God and know he will works everything out for me. I praying for the truth to come out, because I could stayed home but I chose to do right by my boss and he was trying his best to messed me over.

I know, I didnt mean to come off rude...but there are just so many things to address in your statement....I mean you were in Florida, and you live in Georgia...right there at your first hint, you should have been prepared. And whenever you are on the road, you should always have a backup plan to get home in case of an emergency.

You weren't being rude in my opinion, you gave me your opinion which I asked for. I know should been better prepared, and one reason, I won't be a company driver never again. Right now, I am looking to become an Owner operator with my own authority in the near future. This company did a poor job of taking care of its equipment and I don't care to go throw what I just went through again. Thanks anyway.

Why truck trailer #, color, gallons to the tenths?? It sounds like you are testifying to us. TMI.
If you fueled in GA you should of had enough fuel to make the whole trip.
You were home, why didn't you empty the truck then?
Why even go to a dealership?
The company could of issued you a comcheck or Tcheck for the fuel. They could of even used Western Union.
Besides all that being shut down ought to be a big red flag. That's the only case survival mode kicks in. I would of cleaned my truck out in GA and demanded being payed up front if that truck is going to move another inch. So what if they scar your DAC. You dispute it and as soon as there no company to reply or they found they were shut down, you would of won.
Why were you working for this company in the first place?
Since you drove almost all the way there and turned around, you did steal the truck the moment you turned around and defied company orders.
I don't know what to say to you. You made a lot of bad decisions. It's not like you are bad person but you are going to be treated like one now.
I wish you luck getting out of it. You definitely need a lawyer.
Next time post on here before everything starts and we could of saved you a lot of trouble. -
Condo, thanks for your opinion, but there no way driving a Peterbilt truck from Moultrie Ga close to GA and FL state line I would had enough fuel to go to Kansas City Mo, then back to Chicago bobtailing after turning the trailer in in KC. From Moultrie GA to Kc is very close to a 1000 miles and it was very low on fuel then. Now If you like me to drive 55 miles a hour that one thing but it didn't have enough fuel and one reason I called them after finding out that the fuel card was off. He told me to put fuel in the truck and he pay me when I get there. If he was gone to pay me he would pay me my check he owned me with no problem. Come on man and think sometimes.
I already told you in the first statement that he told me that he was taking me to another company with him. That is the reason, I had everything in the truck in the first place because I thought I could trust this guy and he lets me down and I lets myself down without thinking more about the situation. I should stayed home and demanded being paid like you said but as I said before I put my trust in my boss because he hired me in the first place after being out of the industry for a while and as you know every major trucking companies want you to take a refresh course before hiring you.
