    Next time (hopefully there isn't a next time), tell your wife to call the State Patrol. They are DOT officers and in these days of CSA, have much more power in getting things done.

    nope our state patrol did not have anyone to send ......they did arrange for the hook ....i would have thought they would have flew down there to take care of this one but was not a priority for them ......

    Sorry but you're wrong. You're already governed by the "Implied consent to alcohol testing " under the FMCSR §383.73. So when you refuse and the system works as written you give up your CDL for a year and for what? To prove a point. I respect your time behind the wheel but that advice is just reckless.

    When you sign up for your DL even a car one they say it's implied consent on the forms. When the police bother you, they tell you the samething thats it's implied consent.
    They even filled out the form on me to have dl suspeneded cause I told NO I'm not blowing. Not once but twice I never had my DL suspended, I will supply you my info if you want to check the record for yourself. This was in the early 2000's not sure what type DL I had then.
    Let me also be clear I don't drink and drive my truck either.
    This was back when I was younger. But the same still applies if you think your going to get a DUI why help the police it's not going to help.
    lawyer up if you have a problem and shut up, exercise your constitutional rights.
    You have any idea how many inoccent people go to prison and jail?

    You do whatever you want but I can tell you from experience you can beat DUI"s and get them reduced if DON"T help the police.
    There's a ample supply of fool's already they have why should they do real work when they can convict the compliant ones and reduce or dismiss the rest.

    Man am I missing something? According to the chart in 383.51 unless ten years have passed and he completes substance abuse program he is supposed to have no license.

    Couple of things come to mind, where these all with the same company? Is it possible that this was a chameleon company? Changing names or DOT numbers every year or two? Otherwise I really don't see how this is possible!!! Any chance you could give us a hint of what state his lic. was from, or the company location?

    First: let me be the first to say something don't sound right about your story?
    Second: you do realize those blow machines can be manipulated to give erroneoius readings? (ie above the limit)
    Third: If the state police wouldn't come do they nothing something the rest of us don't?
    fourth: why shouldn't his company want to bond him out? Down in Al. we take care of our own.
    Fifth: was the testing done within guidelines setup by the fmsca?
    I see a whole bunch problems with the way you've presented this.
    If it was my driver I would have told him to only take a test that meets guidleines set forth in the rules and ask to be taken to a proper facility for testing. The police always try and get the results they want no matter what and are not to be trusted under any circumstances.
