    Hours of service of drivers

    § 395.5Maximum driving time for passenger-carrying vehicles. Subject to the exceptions and exemptions in §395.1: Code of Federal Regulations485


    (a) No motor carrier shall permit or require any driver used by it to drive a passenger-carrying commercial motor vehicle, nor shall any such driver drive a passenger-carrying commercial motor vehicle:(1) More than 10 hours following 8 consecutive hours off duty; or(2) For any period after having been on duty 15 hours following 8 consecutive hours off duty.(b) No motor carrier shall permit or require a driver of a passenger-carrying commercial motor vehicle to drive, nor shall any driver drive a passenger-carrying commercial motor vehicle, regardless of the number of motor carriers using the driver's services, for any period after'(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.[70 FR 50073, Aug. 25, 2005]

    You get it fixed and hope your drivers are smart enough to run a legal log book during the time when the elog fails. I put together a little something like this http://portal.sliderocket.com/ALDYM/one-to-share Probably a good idea for you to make something like this and customize it to your specific situation. Might help the powers that be to see what they should be doing.

    Whenever our drivers get checked by dot that is the first thing they look for is the recaps page so how can you say it's not required?

    Thank You Autocar you have been extemely helpful.

    I wish dot would change the wording in the instructions on the recaps because that technically is false information, as far as the recaps instructions go anyway. It should actually say subtract 70 from line C (Which would be the 8th day)

    Can you prove it because I would be the first to sign up for that. I hate filling out that summary, been filling it out for 25+ years I can do my logs in my sleep...LOL

    There is no reg requiring the recap to be filled out. It is only provided as a convenience.

    Question 16: Are drivers required to include their total on-duty time for the previous 7 to 8 days (as applicable) on the driver's record of duty status?
