Correct me if I am wrong, if you fail to PMCS (Pre-trip) and something goes wrong because you failed to do the right Pre-trip or ignored the signs doesn't something like that fall back onto the driver, not the carrier? And if he knew the problems it would also be the drivers job to notify his carrier of the issue, knowing most large companies they wouldn't send him out if there was a problem, not for drivers safety but more for the fact the company doesn't want to be sued.

No, you are painting with a very wide brush, things break, I passed a us exp driver once, looked over at him and told him to get the hell off the road, his left front wheel was coming off. Was the seal leaking before he started of after he started?? I do knot know, but the bearing was pretty well cooked.Traveler51 Thanks this.

Equipment, inspection and use.
(a) No commercial motor vehicle shall be driven unless the driver is satisfied that the following parts and accessories are in good working order, nor shall any driver fail to use or make use of such parts and accessories when and as needed:Service brakes, including trailer brake connections.Parking (hand) brake.Steering mechanism.Lighting devices and reflectors.Tires.Horn.Windshield wiper or wipers.Rear-vision mirror or mirrors.Coupling devices
I believe you have just described one of those nifty walk around inspections done at scale houses.
