I don't drink so I am just adding this to cause trouble.
Many states have different laws. In Missouri it is perfectly legal to drink and drive as long as you are not drunk. The federal law does not make having alcohol in your truck a crime. I would bet company policy would put your job in jeopardy or double jeopardy where the value of the questions are double.
What really burns me is that one driver is out there snitching on a follow driver.
Again, just trying to cause problems.

FMCSR prohibits any alcohol to be carried unless it is on the manifest while you are on duty. However , I have seen an FMCSA guidance question that stated a driver that is off duty is exempt from FMCSR . You can stop and purchase and carry alcohol while bobtailing home or to a hotel.

On the other hand, stupid is defined by natural selection.
Good luck finding a competent lawyer to defend against having open or consumed liquor in a commercial vehicle at any time.
Better luck finding another job with a "dismissal for" on your permanent record.
As for the juvenile "ratting another driver" statement... take your "gangsta" attitude and insert it. I'm not risking my life and everyone else out there for a moron alchoholic who can't leave the booze alone until he/she gets home. -

If you're in the closet as an alcoholic trucker, you need to seek treatment and self report yourself to your employer as such. If you lose your ability to make a living, you are protected by the federal law " Americans With Disabilities Act ".
The AWDA covers alcoholics and protects your rights to work or go on S.S.D.I. . Better to get the help you need than putting the safety of everyone at risk. After 45 years of OTR trucking I have seen enough blood on the highway. -

So if I'm on a reset and rent a room I still can't drink on the first day? If I can do it I can still get in trouble with a company if someone snitches that your drinking in a motel room

I usually waited three times 8 hours since last drink. Or when the hangover went away. Whichever is later.
Also after 1991 no alcohol anything in that truck.
