In Need of Legl Advice ASAP

    Hi guys,
    I have an urgent question for you. My truck and trailer were parked in the yard during the night. Next to it was a reefer that exploded and set my , other truck, and a vehicle on fire. Everything burned to the ground. When I called my insurance, I found out that the physical damage part of the policy expired last week. The cargo and liability parts are still current. It seems that I will not be able to go through my insurance for monetary compensation. I was told that I can go after other guy's insurance. Did anyone had to deal with similar situation or hasany advice for me as to how to proceed in this matter? I live and work in CA.

    I would find out everything I can about the one that burned. Also whom is the landowner. Need to know if the burn'ee had insurance and how much. You might have an action against the land owner...... depends on what his role is allowing the burn'ee on his property.

    You're screwed if your leased to the landowner and so was the reefer. If you sue him well I don't need to say more there. Their relationship could be key to your claim.

    You have an action here no doubt...but it's complicated and will likely result in a legal battle.

    You may have an action against your own carrier too. It will be sticky but did they tell you the policy was expiring? Hmmm?

    Also start gathering at least 6 months of bank statements. You will have a claim for down time but will have to prove it.

    I'm no lawyer...no sir...all I've said is common sense. Seek competent legal advise yesterday....before the fire happened....see? Just remember , nobody is your friend and nobody cares if you eat tomorrow. This is a kitchen full of ####roaches and somebody just turned on the light.

    When something like that happens go talk with an attorney. Of course the other guy is liable when he doesn't maintain his equipment. Also who ever owns the land can possibly be held responsible with premises liability. I would think you have many outs.

    Was it a company trailer?

    I just went through this with State Farm. I dont have state farm but the other guy did. Surprisingly they agreed to pay me the amount per day i had asked for with no documentation. Received the 2nd of two checks today!!!!
