company not paying you

    what do you do when company is giving you the runaround with your money. i came back to this company i worked for previously. i suppose to be getting paid after each load. they keep telling me they are going to correct problem and get me my money...its been over 3 weeks now and i still havent got my money. they assured me yesterday they were putting it on my card friday. they posted only 2 tripson qualcome last night when they owe me for 4 trips totaling 4066 miles then they pushed the pay date back untill monday i need to do something or get in contact with someone who can help get my money...need some truckers rights info and contacts

    You need to contact your State's Labor Board (404) 656-3017 to file a complaint. In some states, you can file a complaint online, unfortunately, while looking at the Georgia Dept. of Labor website, it does not appear that Georgia is one of them. If you DO file a complaint, your employer can, and most likely will fire you, violating other laws.

    Been there; done that, and I am 3 for 3.

    So how much money did you get in each of the 3 lawsuits? If you didn't, you should have.

    Now, why would I give you (or anyone else in a public forum) this information?
    Suffice it to say, I got what was owed to me. (Which is ALL you will ever get)

    It all depends on your state, but here in Missouri, the only recourse you have as a truck driver is small claims court. The Department of Labor does not get involved with a dispute over unpaid wages for a truck driver.

    We have been screwed a couple of times, and never got a dime, because of the law of this state.

    I believe that might be the same in Illinois. A friend of mine did not get paid from a company and the dept of labor gave no support.

    some carriers have you sign an agreement to abide by the labor laws in their particular state.
    in my case it was tn
    nice of them I got my vacation pay after quiting by quoting the exact tn laws that allowed me to. got paid with in 2 day's after emailing the labor dept of that state with the same laws etc.. .
    also if you have a company policy book make a copy of the pay page's.
    at the very least for your own reference.
    Once you quit and if the labor dept doesnt help you.
    file in small claims make sure to keep all doc's trip numbers etc.......
    of course this very well could be a clerical error in wich case you would be burning a bridge.

    That does not mean the employee does not have "Private Right to Action", meaning if the State's Dept. of Labor does not (or can not) act, the employee has the right to file suit.
    My first two cases were handled by the Michigan Dept. of Labor, while my latest one is being tried in the U.S. District Court; Eastern District of Louisiana (Case: 2:06-cv-10782-HGB-JCW), because even though Louisiana DOES have fairly comprehensive Labor Laws, the Louisiana Legislature has not given the Dept. of Labor power to enforce those laws.

    Exactly, "Employee Handbooks" are a very effective tool in wage or labor disputes with a former employer. Michigan is different somewhat, in that as far as Michigan is concerned, their labor law takes precedence over any other state's labor laws, if Michigan Laws are more strict.

    contact a lawyer asap. then contact the labor dept. Don't let them snowball you. It's your money. Hold there feet to the fire. I guarantee they would do it to you if you owed them money.
