can a company take your cdl?

    This is silly. How can a company take either a state or federal license? What if they put in there that they could take your passport? Would you believe that? Of course they cannot. You might want to read that again as that is so over the top I can't believe that is exactly what it says.

    A license is a Federal one issued by the State. A private company can not take it from you after you have passed the test and had it issued to you. The most they can do is sue you for the cost of the school and any fees you agree to pay in signing the contract. If you sign a contract to pay them back for taking the school after they fronted you the money then either work for them until it is satisfied or pay your debt to them and call it a day.

    people put all kinds of things in contracts that they truly have no right to. Landlords do it all the time and say you signed the lease! This happens a lot and only works if you don't know your rights. If you know your rights you can't be ripped off or tricked or bullied into something. My dad had a contract and his boss tried to enforce it when he quit including sending copies to his new job trying to get them to fire him or they would get sued. So my dad sued his old boss and the little jerk walked into court with a smug grin on his face contract in hand until the judge told him that the contract violated my dad's rights to work. He had to pay restitution LOL A contract does not over ride the law or your rights.

    the only one that can take your license, no matter what the class is a judge.
    Even a state office or federal office has to go thru the courts to have a license revoked (as in cases of child support not paid).

    no no...i went to a cdl school , 5000usd, didnt pay, filed cht 7 , i have my cdl....be careful what ur signing yet some things just arent legal so be cautious too, you know?

    A contract is enforceable only if the provisions in it are legal. Can you imagine signing a contract to be someones slave? That would not even survive a preliminary hearing. If they said they going to start court proceedings to try and have a judge temporarily take your cdl until you paid back the money that would be interesting and they could but I doubt the judge would go along with it although I never thought Obamacare would survive a court challenge either.

    This almost sounds like either the driving school at C.R. England, or you're talking about License Plates, if you're a Lease/Operator for Swift.

    Would appreciate more information as it's bad enough that some carriers are bad, it's quite another to insinuate, and not have proof.... so any additional information and exact language of the contract and it's application would be appreciated.

    Is your husband "buying" the truck? That might at least give us an idea if that is what you're referring to.....otherwise we can't properly answer you.
