Individuals and safety departments have the right to interpret regulations any way they want . If it's accepted , fine . IMO I can't see how an inspection report can be written without doing an inspection. That's why we hear complaints from drivers picking up empties that have defects.

Thanks to Condo Cruiser for clearing up the often misunderstood "Post Trip Inspection" issue. As Condo pointed out the requirement in Title 49 is that the inspection report (DVIR) be completed at the end of each work day. The requirement to perform an actual post trip inspection is found in 396.15 and applies only to driveaway-towaway operations.
Question 25: Section 396.11 requires the driver, at the completion of each day's work, to prepare a written report on each vehicle operated that day. Does this section require a ''post trip inspection'' of the kind described in §396.15?
Guidance: No. However, the written report must include all defects in the parts and accessories listed in §396.11(a) that were discovered by or reported to the driver during that day.
I interpret the requirement for a pre-trip inspection a little differently. 396.13 states that "Before driving a motor vehicle, the driver shall, Be satisfied that the motor vehicle is in safe operating condition...". I believe this section requires that the truck be checked "before" driving it (Pre-trip). Additionally, drivers should be aware that there may be more restrictive requirements imposed by the states. I'll use California as an example.
Title 13, California Code of Regulations
1215. Vehicle Condition.
(a) General. It shall be unlawful for the driver to drive a vehicle that is not in safe operating condition or is not equipped as required by all provisions of law and this chapter.
(b) Daily Inspection. Pursuant to Sections 1202.1 and 1202.2, all drivers shall perform vehicle inspections and submit written reports in accordance with the requirements of Title 49, Code of Federal Regulations, Sections 396.11 and 396.13, as follows:
(1) Before driving a motor vehicle, the driver shall:
(A) Inspect each vehicle daily to ascertain that it is in safe operating condition and equipped as required by all provisions of law, and all equipment is in good working order;
(B) Review the last vehicle inspection report;
(C) Sign the report, only if defects or deficiencies were noted by the driver who prepared the report, to acknowledge that the driver has reviewed it and that there is a certification pursuant to subsection (f) that the required repairs have been performed. The signature requirement does not apply to listed defects on a towed unit which is no longer part of the vehicle combination. -
It takes me less than 30 seconds to sign my name to the Daily Vehicle Inspection Report. A post trip inspection is not required, only a pre-trip.

I did a pretrip inspection, before I started driving for the day. Everytime I stop and get out, I look for any problems. When I park, at the end of my day, the regs do not require another "Inspection", only that the Inspection Report be filled out and signed.
With you being a certified inspector, I am surprised you are not familiar with this:

BTW, the Maryland inspector that I had the go around with and pointed the reg out too asked me, "Well, what if you park the truck and there is a nail in the tire?" My reply was simply, "You'll find it when you do your pre-trip." His partner about fell out of his chair, he was giggling so hard.Last edited: Sep 7, 2012
