I think I'm sunk...and the ship hasn't even set sail!

    Man I wish I lived in tennessee right about now. Here in cali its 456 dollars, minimum fine no reduction, no traffic school and points assesed as if it were issued by a live officer. Highway robbery.

    I believe they set up the cameras with an out of state operation. In Arizona or something like that. A bunch of cities up in the north state have suspended their red light camera operations but not the one I drive in primarily.

    Actually, and to be honest, I have no idea what the csa is even about. Like I said I have a CDL but the truck I drive is C so I've had no experience with the 2010 regulations. But if you're right about it not being a big deal as far as the MVR is concerned then I am relieved.

    u should have goten a citation with the pics stating what offenses were commited like red light violation, speeding ect.
    i tried to search for the pnts for a red lite ticket but couldnt find anything. id go to dmv with the citation and ask how many pnts im i lookin at for this ticket

    A camera ticket will have no effect on your career at all. You do not mention it as it is not a moving violation. It is a parking ticket. The ticket is issued against the CAR or TRUCK. It is not issued against the driver. Hiring a lawyer will do you no good at all because it isn't a criminal matter. The company you rented the truck from is responsible for the ticket but they have a contract which covers them. You will have to pay the fine but nothing will appear on any record that charges you.

    I am speak from experience. My daughter drove my car through a red light. She claims her breaks failed. The video which the Arizona Company posted online shows that not only did her brakes fail but so did her brake lights. The worked fine at the next stop light. My wife and I own the car so we both got tickets in the mail. The whole process is unconstitutional but the courts allow it as a tax. Pay the fine. But don't lose any sleep over it.

    Was your daughter in California when it happened? My employer stated extremely clearly that he would have to turn me in and that it would definately be a point against my license (or 1.5 points, since I am a commercial licensee). I sure hope your right though, Driver

    It is a basic tenet of the American jurisprudence system that the accused has the right to confront and question his accuser. You can not question a camera. Therefore it is a civil penelty and not a criminal matter.

    If you have ever challanged a ticket you recieved in court, you should lnow that the issuing officer is required to testify from independent recollection, meaning he can not read from the ticket becuase that would amount to the ticket accusing you and you can not cross examine a ticket...

    It's the same principle and this is why prosecuters so often lower the charges and the fines, even to non moving violations. Representing myself in court against a speeding ticket (4 wheeler) I had a 53 in a 35 amended to bad brakes... $42.50 plus costs and no points.

    You should be ok, but check with DMV on the points first.

    im pretty sure that you can get it thrown out even with a CDL if you got it in California
    if i remember right the applet court ruled that the red light camera doesn't follow proper evidence rules and violates the 6th

    let me know if it was in california i look for the case
    and beware of valtery payment doctorine

    It definitely adds points on your license in CA. I know a couple people that got out of them down south here with an attorney and another who even represented himself in court and got it dismissed, but none of those in a commercial vehicle. I would try to beat it personally.

    And different appellate courts have ruled differently on the legality of the tickets so that's not going to help. In fact, some cities would love for the state Supreme Court to rule them unconstitutional as that's the only way they can get out of the contract for the cameras. Most cities here actually lose money on the cameras. My city loses over $100,000 a year with them and tried to weasel out of the deal but was only able to reduce the amount of cameras, not get rid of them all without paying a large penalty.

    Not to hijack the thread but how would the video show that the brakes failed unless it showed her depressing the brake pedal?

    The answer to that is right in the quote.........

    The switch for the BRAKE LIGHTS is connected to the brake pedal. So IF she depressed the pedal and the mechanical part of the brakes failed the lights would still come on with depression of the pedal
