I'm driving for Trans Am right now....as a matter of fact, I'm sitting at the Flying J in Dodge City waiting for Cargil to get a load ready that has already gone 6 hours passed drop dead. Trans Am did try to commit criminal fraud against me when I leased my truck. The truck developed an air leak in the fuel system and lost prime. It broke down twice with me in 4 days. I got it fixed after I got back to Olathe but unfortunately, we had to tow it the first time it broke down in Cartersville Ga. The tow bill and "work" done by the Kenworth in Atlanta was $1600.00, Kenworth saying all they did was prime the truck and it cranked right up. I paid them, and picked up a load in Dalton Ga going to Kansas City, broke down again at the Oak Grove Petro in Missouri. Anyway, to make a long story longer, leasing said "Don't worry, you're covered under the 30 day unconditional warranty." Then road assist falsified the breakdown report and put down that I ran the truck out of fuel - claiming I did it twice in 4 days - which is an outright CRIMINAL fraud, because they made me pay the $1600.00 tow bill (which included to tow their trailer no less). I eventually spoke with Kenworth and Kenworth agreed to re-imburse my money to me, but Trans Am refused to refund my money until KW sent them a check. The only thing the 30 day unconditional warranty doesn't cover is driver error - such as running the truck out of fuel.
I told Chris Gephart, the general operations VP, Trans Am is an extremely lucky trucking company that I don't have everyone who had anything to do with defrauding me put in jail and charged with two counts of criminal fraud. His reply, "We're going to keep this quiet."
1. I didn't run the truck out of fuel. Travel Centers of America mechanic could not get the truck to crank. Truck had 1/2 (100 gallons) tank of fuel. Towed to Kenworth in Atlanta GA.
2. Kenworth in Atlanta added no fuel to the truck. I have the invoice of the work performed.
3. On the 2nd breakdown in Oak Grove MO., Petro mechanic added no fuel to truck, I have the invoice of the work performed.
4. After getting the truck to the shop in Olathe KS, the shop discovered the air leak in the fuel system which was causing the truck to lose prime.
5. Road Assist was ordered to falsify the breakdown report in order to defeat the 30 day unconditional warranty offered by Trans Am by falsely stating I ran the truck out of fuel.
I state for the record that the above is true and correct under penalty of perjury.
Trans Am WILL try to rip you off. The ONLY reason I didn't have anyone arrested and put in jail for this fraud is because Kenworth - not Trans Am - was willing to re-imburse me my money. If I had to have taken this to court, I would have sued Trans Am for damages in excess of 1 million.
P.S. Why am I still here? Just getting enough experience to leave.

I read many posts on L/P'ers blues---and I will never L/P---I will either own the truck and plate or I company drive. I like Killler Bug's structuring of how to make money trucking; however, his insistence for L/P'ing, especially for noobs such as I, is just plain folly.
What intrigues me about your post is the implication of perhaps K-Worth is running Trans Am. I am not saying that Trans Am is a direct legal subsidiary of K-Worth, but maybe K-Worth is pulling more strings at TA than a typical truck builder 'at-arms-length' would. This is a deck that is twice stacked against the L/P'er than the regular Lessor/Lessee/Purchaser relationship.

How do you know if fraud can or cannot be proved in the O/'P's claim? Are you a practicing attorney or Judge or other legal expert???!!
It appears to my eyes that Southern Star has enough of a case to at least present it to lawyers on a contingency basis. The power comes when Southern Star can get fifty or more such persons like him to join in a class action against the defendant(s).
This said, it seems that the bottom feeders, such as TransSham, insulate themselves somehow from legal proceedings---how else is CRE still around today? However, this does not necessarily mean the Southern Star does not have a case; only a Judge can have power to decide if he does or not.
