I haul O/S O/D and heavy, every scale that I run across is open you are required to go and get weighed no matter what the lights say. To bypass and get a ticket is a moving violation in Georgia, might as well not had a problem but most states are cranking down on permit loads anymore.

I think fine for passing a scale is $500. Friend of mine got it a year ago in GA.

There is no acceptable reason for passing a scale. Tell them what you will but driver inattention is inexcusable in ANY state.

Ignorant question then....does anyone have any success hiring counsel and plea-bargaining these tickets down to a non-moving violation or something not as serious? That might help insurance and CSA

i have a buddy of mine by passed a scale by accident and dot went after him he ended up with an $1100 ticket there not cheap your better off getting a ticket for being over weight mine was only $180 in Kentucky

Getting ticket reduced won't have ant effect on CSA score. Believe it or not the people that evaluate this are smarter than that.
And with all the stress about the score you must not understand how it works. If this is the only thing you have then it will be a blip.
Your new entrant audit should be your concern. Make sure you go over the top documenting all the things you have done to educate the driver and that you made it clear that this is unacceptable. When you get your audit this will be reviewed.aiwiron Thanks this. -

BigBadBill is 100% right. Your audit will be the biggest thing you need to worry about. Being new in the oversize transport business you should hire a driver with oversize experience. If he doesnt know that he needs to stop at scales and sign a permit, what happens when something goes wrong on the road? How will he handle a stressful situation?
