    This is incorrect. Licensed amateurs are NOT restricted from using "export" , or the so-called "10 Meter" radios on the amateur bands. The restrictions apply to Part 95 and CB radio because they are not certified for such use. Amateurs may use ANYTHING that will meet the standards of Part 97 and does not cause interference to other users. Amateur radios do NOT have to be certified for use within the Amateur Service, only meet certain minimum standards of spectral purity. CB radios must be "certificated" for such use because that "service" is part of the Land Mobile Service and requires certification for equipment used for it. What prevents most amateurs from using "10 Meter" radios is, the physical limitations of the sets themselves and something of a "stigma" within the Amateur Service against using them---"snob appeal" in reverse as it were! Amateur sets are not "channelized", do not have beeps, squeaks and snorts, and don't follow the fluid nature of Amateur use, or their coverage of the 10 Meter band is limited. After all, they ARE a disquised substitute for a CB radio, sold because of "extree" channels, easy modification, and power beyond that allowed for 11 Meters!

    Gadfly is spot on.On another radio forum a member posted an email from the FCC stating basically what Gadfly posted here.I have never seen "The List" on an official FCC letterhead or on their website.

    Now *I'm* not sure, either. It occurs to me that everything I've seen has been either paraphrased or excerpted, cut & pasted. I've just this morning written an email to the Wireless Telecommunications Branch at FCC asking for a clarification. I admit that I may have been sucked into the vortex of vitriol and emotions that often run high when heels get dug in firmly about "all things gummint", and will see what comes directly from the horse's a@@...err, mouth in Gettysburg.
    I'll post my question and whatever reply I get in full in an appropriately-titled new topic, since we seem to have gotten off of the OP's question here.

    The FCC has flip-flop on this bottom line seems to be if your a ham and the radio is not modded to cb it is legal on 10 meters......

    It always was. Where the "rub" came in, and where it first became an issue was when CBers began to buy them in droves, AND then start showing up on the 10 Meter band where they don't belong. The EASIEST way to tell if a radio is OK to use on CB is, look for the tag or sticker on the back or side with an FCC Certification number on it. If it has no such #, then it is NOT certificated, nor OK, for CB. Your legal, 40 channel CB radio will have such a sticker. Now, look for the sticker for your IC-706. You won't find one on it, either! That's because the Rules for the two services are different: Part 97 (ham) versus Part 95 (CB). Part 95 specifically prohibits the use of non-certificated (the new FCC double speak) equipment on 11 Meters. Part 97 has entirely different rules, some pertaining to bands and frequencies (ham radio has no "channels" except for the 60 Meter band), others to power allowed (1500 watt max)--and even THAT has certain restrictions. Like the so-called "10 Meter" 'amateur' (in a pig's eye) radios with all them extree channels, easy modification, and more power, regular amateur radios, such as the IC706, et al, are not legal for use on 11 Meters. But the "10 Meter" radios were meant to slide under the FCC radar disquised as "ham" radios in order to skirt the law. Some of us can't resist getting on "them 'funny' channels", or they don't know better, so they end up ON the lower end of 10 Meters running voice in a digital "pasture". It sticks out like a sore thumb to hear a truck, thinking he's on "the truckers' private channel" talk on AM up there, OR up the band where everybody else is on SSB. They end up getting nailed by angry hams who DF them and turn them to the Feds. OR the hams interfere with them by sending RRTY and other digital signals at high power to "jam" them. It is perfectly legal for a ham to call "CQ" right over the top of them in CW because there is NO protection against signals generated by an ILLEGAL station. It's like growing a "maryjane" field, then calling the cops because someone stole your crop!:biggrin_2559:

    i have a question guys. is my connex 3600 hp legal to use. i had it on ebay for sale and had 6 bids on it then ebay pulled it and said it was illegal to sell yet i see other 3600's for sale on ebay. what gives any ideas. RW

    Your radio is not legal to use on CB, it's not certified for CB use, it's not really any good to use on the 10 M band. Your auction was pulled most likely because eBay caught it as an illegal radio being sold. Depends on when/if they catch your ads. I've gotten anyway with selling export radios on eBay but had my linear amp auction pulled.
