Recent Graduate with Minor Misdemeanor

    So I graduated on july 25th, 2012 and been looking for jobs for a month and having really hard time finding job. Every time i talk to any recruiters, after i tell them about my minor misdemeanor: possession of marijuana. They flatout tell me they cant work with me. what should i? the charge is about 2 yrs old and there is no way i can wait another year because of the 3 yr old requirement. I'm in cincinnati OH.

    I just got out of a truck to become a HR/Safety person, so I have some first hand, recent experience with your difficulty. I'm not a drug user, never have been. I am a perfson who recruits drivers, Im the nasty SOB that has to say "sorry, have a nice day, NEXT!"

    First, the driving school appears to have "taken your money" to teach you to drive Vs telling you that you "may" not be hireable in the trucking industry if you have recent drug, misdemeanor, felony difficulties.

    Our Liability Insurance carrier basically says, if you need to hire one of the above mentioned people, do so at "your own risk", frankly you can imagine that if an Insurance Carrier doesn't/wont take the risk, I representing a Motor Carrier cant either, what do they know that you don't understand?

    Could you tell me why, after being a drug user, you would head off to being a "truck driver" Vs maybe a brain surgeon whose first patient would you first born or maybe your spouse, mother, father or somebody who really "matters to you", it doesn't appear that other people sharing the road with you have any bearing on your decision making qualities? Do you see the risk here?

    Now back to reality, as a Carrier, somehow you see me just saying "no problem", take this $150K tractor, hook it to that $35k Trailer over there, take off and give our Dispatch Group a call when your empty and Have a Nice Day?

    If "I" were sitting in front of you, would you do that for me?

    Could I ask something of you, the word "minor" implies "no big deal", are you starting to see that "it might be a bigger deal in the real world than your were prepared to see while under the influence of Marijuana?

    Expunging is a pretty good answer, it would leave me wondering why?

    Sorry your a "risk" thats hard to take, I can hold out for a better applicant...............maybe a brain surgeon who has turned to truck driving

    What do you mean wondering why for expungement? Expungement means that you have proved to the courts that you have changed your life, the reason behind expungement is to help people that have learned there lesson and changed there way of life to be able to get good jobs, not because they are hiding anything.

    Stepping away from my job when I reply............would you be ok with letting your daughter date this gentlemen and driving into the sunset for a night on the town? How about him giving your wife a "lift to the super market"?

    From Wiki: In the common law legal system, an expungement proceeding is a type of lawsuit in which a first time offender of a prior criminal conviction seeks that the records of that earlier process be sealed, thereby making the records unavailable through the state or Federal repositories. If successful, the records are said to be "expunged". Black's Law Dictionary defines "expungement of record" as the "Process by which record of criminal conviction is destroyed or sealed from the state or Federal repository."[SUP][1][/SUP] While expungement deals with an underlying criminal record, it is a civil action in which the subject is the petitioner or plaintiff asking a court to declare that the records be expunged.

    Maybe you can help me to understand...........you screw up, get caught and don't have to face the consequences.

    When I have screwed up and there has been more than "one time", I had to face mine, didnt you?

    Or, go out and buy tractor of your choice, trailer too and put a sign on the side. "Only Pot Heads Need Apply to Drive"

    And one final comment, do you believe for a instant about it being the "first time offender"?

    Im OK with people telling me I made a mistake, ive certainly made mine. If they have shown that they no longer have the "need for weed", then OK, I will test them, my insurance company and the Feds tell me I have too. See if they can drive, check for experience of 2 years, 23 years old and no more than 6 points on MVR and put them to work.

    Just yesterday, I suspected that I had a driver who was impaired, sent him as a "random", blew a .12 "3 times the legal limit" to drive commercially. Do you believe it was his first drink or driving time driving under the influence?

    Come to find out, once he was selected to random check, he stopped at a pub on the way to the testing center and "downed a few" before going to be tested. Told me he thought he was going for a drug test...............not a Breath Alcohol Test (BAT).

    I see your point, I didn't know that some states actually do that as Arizona only sets aside the case...Arizona does not have an ‘expungement’ statute. Instead, A.R.S. § 13-907 permits a defendant to request a "set aside" of his conviction under certain circumstances. If a person succeeds in persuading the judge to set aside his conviction, a records check will probably reflect that the defendant was originally charged, and convicted, but that the judgment was eventually set aside and an order of dismissal was entered.
    In my situation the judge and the district attorney have taken my case, they look into how far I've come, am I sober, have I made an effort to become successful, have I stayed out of trouble, and so on. And I have, I've got almost five years clean and sober, I've got an associates degree, plus I have obtained many other certifications along the way but driving is in my blood, my case was set aside, all rights restored including my right to bare arms! My case is not sealed, it's still on my background I simply shows that it has been set aside!! Thanks for your response

    check with BULK TRANSIT from plain city oh. they prob help you out, when i started almost 12yrs ago they were the only ones that would count my permit time as expeerience,since i didnt go to a driving school,they were good company to work for starting out i was home every night and weekend and was bringing in avg 750wk home and had good benefits,they have several terminals around in,mi,in,ky,wv,....just an option hope it helps
