Can my husbands employer take all of his paycheck and leave him with a negative amount?
Back story is my husband is an owner operator and works for a company.(he doesn't have his own rights) With all deductions that come out of my husbands check,we haven't received a paycheck in the last 3 weeks and won't be receiving one this week either. He has to pay fuel and cash advances for the week along with a truck payment,insurance,his child support is taken out of the check too,also a back parts bill is being paid every week.In May we found out that we owed around $34,000 in back fuel and cash advances.We don't know how it got so far behind.But I have seen the fuel and cash advances that were owed and matched them with back fuel receipts all match.The company took all back fuel and cash advances and rolled them into a loan. Which we now pay 300.00 a week.
It seems like the more money he makes they just seem to be taking more money from the check.
Can my husbands boss do this?

you owe the company more than $34k and this is a surprise to you?
something is not quite right here, seems like the company has been bankrolling all of the expenses on your truck and they want to get their money back
if i leased onto someone and borrowed over $34k, i am pretty sure they would want their money back, quickly, because your husband could leave them hanging dry with that type of debt

cash advances.. he is taking money early before his "payday" so your not "REALLY" negative.. also, how the f do you not realize how to better the situation before your in 34k debt???

This is a really...really sad situation. Only wish I could think of an answer, because continuing on appears to be a hopeless cause.

that is called dishonesty, even if it is legal
he is an owner operator, ie, his truck, he needed repairs for whatever reason, i dont see that as a bad thing, the company fronted him the money, he owes them
maybe he put on too much chrome, maybe he did a complete rebuild, but they loaned him the money in good faith knowing they would get it back
he just has to develop some financial discipline to get out of the hole, cash advances only prolong the pain -
1. Your taking cash advances so your not in the hole...your husband is getting a precentage of his money up front and when its time to to settle there is nothing left cause he already got it ..... 2. Your husbands child support is his own responsibility this leads me to believe that he is somehow just making a truck payment to an owner .... Only an employer can take child support payments and if you are an o/o or a l/p you are responsible to make your own payments .... 3. Since you are 34k in the hole this leads me to believe that your husband was given some type of grace period in wich he saved nothing and has poor business management skills so I would not question if this is legal I would begin to organize your finances and attempt to crawl out of debt ....

First step I would take is cut my losses cancel the lease, sell the truck, and walk away from "truck ownership". Get a company job, write down a budget for weekly household expenses, live within your means, and slowly dig yourselves out of the hole you're in.
